Important legal distinction: premises lease or service agreement?
If a lease in practice entails that a building or part of a building is let for use in exchange for compensation, Chapter 12 of the Swedish Land Code (Jordabalken) may be applicable. Therefore, calling the agreement “coworking,” “membership,” or “service agreement” does not automatically mean that tenancy regulations are irrelevant.
The package contains a separate guide that helps the parties identify factors that support a premises lease versus a more service-based coworking arrangement, such as exclusive right to a certain area, the possibility of moving the user between locations, the lease term, and the scope of services.

Access, security, and inventory
The package also includes a separate appendix for users, access cards, keys, inventory, physical security, information security, fire safety, and return of items at the end of the agreement.
If the lessor is a tenant themselves
If the lessor is a primary tenant themselves, the head lease must be checked. According to Chapter 12 of the Swedish Land Code, a premise may not be sublet for independent use without the property owner's consent. If consent is refused, the Regional Rent Tribunal (Hyresnämnden) can in some cases grant permission.
Indirect tenure security
If the lease is legally a premises lease, the tenant normally receives indirect tenure security when the tenancy ends after more than nine consecutive months. This security does not mean an unconditional right to remain, but in certain situations, it may entitle the tenant to compensation or a postponement of eviction.
Any waiver of the tenant's tenure security must be made in a separate document and may require the approval of the Rent Tribunal. The package therefore refers to the Rent Tribunal's current forms HN3/HN5 instead of building a general waiver into the main agreement.
Confidentiality in a shared office environment
When several companies work in the same premises, business information may be exposed via screens, conversations, documents, or meetings. The agreement therefore contains special provisions on confidentiality, trade secrets, clean desk policies, visitors, and IT security.
