Car Purchase Agreement 2026 – private individual to private individual

Complete purchase agreement for a private car transaction according to Swedish law. In private purchases, the terms agreed upon by the buyer and seller apply primarily, and the Sales of Goods Act (1990:931) applies secondarily. The Consumer Sales Act does not apply when both the buyer and seller are private individuals. Therefore, a clear written agreement is particularly important.

The purchase agreement regulates, among other things

  • buyer and seller
  • registration number, VIN/chassis number, model year, and mileage
  • purchase price, down payment, and payment method
  • delivery date, delivery location, and change of ownership
  • vehicle condition and buyer's inspection
  • known faults, damages, and remarks
  • sale in "as-is" condition and the limits of liability disclaimer

Important regarding “as-is” condition

The template contains a legally cautious clause regarding as-is condition. Such a reservation does not mean that the seller is automatically exempt from all liability. According to Section 19 of the Sale of Goods Act, the car can still be considered defective if, for example, it does not match information provided by the seller, if the seller failed to inform the buyer of a significant known condition that the buyer could reasonably have expected to be told about, or if the car is in a significantly worse condition than the buyer could reasonably have assumed based on the price and other circumstances.

Checklist for the car purchase

The separate checklist helps the buyer and seller document details that often cause problems afterwards. It covers, among other things:

  • inspection and vehicle status
  • financing, leasing, and retention of title
  • service history and previous repairs
  • bodywork, tires, brakes, electronics, and interior
  • engine, gearbox, and test drive
  • extra check for electric car and plug-in hybrid
  • agreement, payment, change of ownership, and insurance

Check for debts before buying the car

The Swedish Transport Agency recommends that buyers of used vehicles check vehicle-related debts and the vehicle's status before completing the transaction. Some debts may mean that the vehicle can be seized even after a new owner has bought the car. The template therefore includes specific checkpoints for debts, usage status, financing, and leasing.

No right of withdrawal in private car purchases

When a private individual buys a car from another private individual, there is no statutory right of withdrawal. If the parties want a "right of return" (open purchase) or a special right to cancel the purchase, this must be written into the agreement. The template contains optional fields for this.
