Does a co-owner of a deceased estate need to provide a power of attorney in English? With Limited Power of Attorney – Deceased Estate, an adult co-owner can appoint a proxy for specific matters in a deceased estate under Swedish administration and Swedish law. Choose which matters the proxy may manage
The grantor selects what is to be included. Unselected options grant no authority. Mandatory information must be provided for each respective power.
- Retrieve information and documents: specify the organization and a defined matter. For information from the Swedish Tax Agency (Skatteverket), the agency must be explicitly named.
- Attend the estate inventory meeting: allow the proxy to attend, look after the grantor’s interests, ask questions, and receive documents.
- Terminate a specific subscription or service agreement: specify the provider and contract number. Residential rent, insurance, loans, and investments are not included.
- Pay a specified invoice: grant the right to instruct the bank to pay a specific undisputed invoice from the estate's account, with the limitations specified in the template.
One grantor and one proxy per document
Each copy applies to one co-owner's representation. It does not automatically grant the proxy the right to represent the entire deceased estate alone. Necessary consent or valid authority from other co-owners must also exist when the proxy is to act on behalf of the estate. Use a separate copy for each grantor and coordinate the powers.
How to complete the template
- Verify that the situation falls within the template's scope of use and ask the recipient what documents are required.
- Enter the deceased's details, the grantor, the proxy, and the same document ID on all pages.
- State the end date, select powers, and fill in all mandatory details.
- Read the limitations, enter any additional limitations, and sign the entire document.
- Give the proxy a complete document and keep a copy for yourself.
Important limitations
The template does not cover estate distribution, division of marital property, sale or pledging of assets, approval of a will, waiver of inheritance, litigation, or tax returns. It is not a durable power of attorney. The payment option must not be used if the estate's ability to pay its debts is uncertain.
Do not use the template unchanged for minors, appointed representatives, disputes regarding the circle of heirs, foreign assets, or cross-border inheritance. According to its limitations, it may not be used when the estate is managed by an estate administrator, an authorized executor, or a bankruptcy trustee.
Frequently asked questions
Do all banks accept this power of attorney?
No, this cannot be guaranteed. Banks and other recipients may require their own forms, originals, identity verification, or supplementary documents. Also, verify that the recipient accepts English. The guide provides links to information about the banks' own forms.
Can the proxy sign the estate reporter's declaration?
The power of attorney does not grant the right to sign the grantor's personal declaration as an estate reporter. Representing a co-owner at the meeting is a different task.
Can I revoke the power of attorney?
Yes. The guide describes practical steps and why merely notifying the proxy is not always sufficient. How the revocation should be carried out depends, among other things, on how the power of attorney was issued and communicated to others.
