Residential Rental Agreement 2026/2027 – Word/PDF according to the new Private Rental Act

New law from July 1, 2026

The previous Act (2012:978) on the letting of private dwellings has been replaced by the Private Rental Act (2026:772) for rental agreements entered into from July 1, 2026. Older agreements are in some respects still covered by older rules. It is therefore important not to use an older standard template without first checking which regulatory framework applies to the current agreement.

This template is specifically designed for new private rental agreements 2026/2027.

When is this template suitable?

The template is intended for rentals where the landlord is an individual or an estate and the lease concerns a residence that the landlord owns. Examples:

  • condominium (bostadsrätt),
  • detached house or small house,
  • owner-occupied apartment,
  • part of a detached house or other owned property,
  • other owned housing covered by the Private Rental Act.

When should the template not be used without special consideration?

The Private Rental Act does not apply to all rental situations. The package therefore contains a clear checklist before the agreement itself. The template is not intended to be used unchanged when:

  • the landlord is renting out a home that they hold via a rental contract (hyresrätt),
  • the rental is regular and includes more than two homes that the landlord does not use themselves,
  • the lease is exclusively for holiday purposes,
  • the parties are covered by another special regulatory framework.

In such situations, the legal framework should be assessed separately before the agreement is used.

Condominiums – permission from the association

If the rented home is a condominium (bostadsrätt), the condominium association's consent is usually required for subletting. If the board does not grant consent, the condominium owner may, under certain conditions, apply for permission from the Rent Tribunal.

The agreement therefore contains a specific section where the parties state:

  • whether the home is a condominium,
  • whether the board's consent has been obtained,
  • which period the consent covers,
  • whether the validity of the agreement is conditional upon obtaining the necessary permission.

Clear lease term – fixed or indefinite

The template can be used for both fixed-term agreements and agreements that apply indefinitely. The user marks which option applies and fills in the start date and, where relevant, the end date.

The user guide explains the difference between the forms of agreement and why the parties should avoid contradictory wording regarding the rental period and notice of termination.

Termination according to the Private Rental Act

The template is adapted to the rules on termination in the 2026 Private Rental Act. It contains separate rules for fixed-term and indefinite agreements, as well as space for terms that are more favorable to the tenant where the law allows.

As a starting point, the tenant may terminate the agreement so that it ends at the turn of the month that occurs at least three months after the notice of termination. For indefinite agreements, the corresponding three-month rule also applies to the landlord. A fixed-term agreement normally ends at the agreed end date, and the landlord does not have a general free right to terminate it early.

Digital termination and contact details

The new law contains rules that make it relevant to specify a particular electronic address for notices. The template therefore has separate fields for e-mail and other contact details, as well as clear instructions on how notices of termination and important messages should be handled.

Rent – fixed monthly amount and surcharges

The agreement has separate fields for:

  • fixed monthly rent,
  • due date,
  • payment account,
  • electricity, heating, water, broadband, and other operating costs,
  • costs included in the rent,
  • costs charged based on actual consumption.

This reduces the risk of rent and operating costs being mixed up in a way that later creates disputes.

Index regulation – optional and clearly marked

The template contains an optional index clause for situations where the parties want to agree on adjusting the rent based on an index. The clause is separately marked, and the user guide describes that the requirements of the law must be met before a rent change is implemented.

There are also fields for base index, comparison index, calculation month, and time of any change.

Reasonable rent and review by the Rent Tribunal

The Private Rental Act contains rules regarding the amount of rent and the possibility of a review. The agreement therefore does not attempt to lock the parties into wording that would set aside mandatory rules.

The user guide reminds the landlord to document how the rent was determined and to check current comparable objects and legal conditions before the agreement is entered into.

Security deposit – optional clause

There is a special section for deposits where the parties can specify:

  • deposit amount,
  • payment date,
  • how the deposit is held,
  • which documented claims may be offset,
  • when the remaining amount should be repaid after move-out.

The clause is explicitly optional. The package does not assume there is a specific statutory standard model for deposits, but rather helps the parties agree clearly on the handling.

Inspection before and after the rental

A common source of dispute is whether damage existed already at move-in or occurred during the rental period. Therefore, a separate inspection report is included in the agreement.

The report has space for, among other things:

  • walls and ceilings,
  • floors,
  • kitchen and appliances,
  • bathroom,
  • doors and windows,
  • furniture and fixed equipment,
  • other damage or remarks.

The guide recommends that the parties supplement the report with dated photographs.

Inventory list for furnished homes

For furnished rentals, Appendix 2 can be used to document which items are included, quantities, condition at move-in, and condition upon return. This makes it significantly easier to distinguish normal wear and tear from actual damage or missing property.

Key receipts and meter readings

Appendix 3 contains fields for:

  • number of keys issued,
  • tags and access systems,
  • garage or mailbox keys,
  • meter reading for electricity, water, or other relevant consumption,
  • date and signature upon issuance and return.

Condition of the home, damages, and defects

The agreement regulates how the home's condition is documented, how defects should be reported, and how the parties should handle damage that occurs during the rental period. It also contains explicit references to mandatory rules where a standard clause may not limit the tenant's statutory rights.

Insurance

The template contains a section where the parties can document their insurance circumstances. The tenant is encouraged to check the need for their own home insurance, and the landlord should check that their own insurance applies during the rental.

Use of the home

The agreement contains terms regarding:

  • residential purpose,
  • number of occupants,
  • house rules,
  • smoking and pets where the parties want to regulate this,
  • disturbances,
  • alterations to the home,
  • subletting and lodgers.

Access for the landlord

The landlord does not have a free right to enter the rented home at any time. The template therefore contains a special section for access in cases such as necessary maintenance, inspection, or other lawful and objectively justified situations, with regard to the tenant's possession and privacy.

Security of tenure

The new Private Rental Act means that the tenant, in a lease covered by the act, does not have the standard security of tenure that might otherwise arise under rental legislation. This is stated explicitly in the agreement and explained in the user guide.

Frequently Asked Questions

Can I use the template for a condominium?
Yes, provided that the lease is covered by the Private Rental Act and that the necessary consent or permission for subletting exists.

Can I use it for my detached house?
Yes, a privately owned house or part of a house can be covered by the Private Rental Act when the act's other conditions are met.

Can I use it if I rent the apartment myself?
No, not as a standard. If the landlord themselves holds the home via a rental contract (hyresrätt), the situation is not covered by the Private Rental Act in the same way, and a specific subletting agreement for rental properties should be used.
