The Sale of Goods Act and private purchases

When purchasing a boat between private individuals, the Sale of Goods Act (1990:931) applies. The Sale of Goods Act is dispositive, meaning the parties can agree on terms other than the act's standard rules. Consumer legislation, however, applies when a trader sells to a consumer.

A general statement that the boat is sold in "as-is" condition does not mean that all liability for defects disappears. According to Section 19 of the Sale of Goods Act, the boat can still be considered defective if, among other things, it deviates from information provided by the seller, the seller has withheld a significant known fact, or the boat is in a significantly worse condition than the buyer could reasonably have expected.

CE marking and WIN

The pack contains specific checkpoints for CE marking and the boat's identity. The Swedish Transport Agency states that recreational boats between 2.5 and 24 meters, personal watercraft, and engines are covered by CE rules when they fall within the scope of the regulations. A correctly CE-marked boat should normally have a manufacturer's plate, WIN, Declaration of Conformity, and an owner's manual.

Registration and change of ownership

The Swedish Transport Agency states that recreational boats with a hull length of at least 15 meters are subject to mandatory registration under specified ownership conditions, while recreational boats between 5 and 15 meters can be registered voluntarily. For a recreational boat subject to mandatory registration, the new owner must report the change of ownership within one month.

Survey and sea trial

The separate checklist helps the buyer check, among other things:

  • identity and ownership chain
  • CE documentation
  • hull, deck, and through-hull fittings
  • engine, outdrive, propeller, and service history
  • electrical, fuel, and gas systems
  • navigation and safety equipment
  • sea trial and functionality
  • terms that should be settled before payment

Seller disclosures

The attachment documents, among other things, previous damage, groundings, moisture/leaks, engine repairs, insurance claims, import history, CE documentation, and other known defects. The purpose is to reduce the risk of later disputes regarding what the seller actually disclosed.

Delivery and payment receipt

The pack also contains a separate protocol for final payment, receipt, keys, documents, engine hours, fuel level, insurance, and any change of registration or trailer ownership.
