For both motorhomes and caravans

The agreement is structured so that the same template can be used for:

  • motorhomes / passenger cars class II,
  • caravans / trailers.

Fields that only apply to motorhomes, such as odometer reading, engine, transmission, and third-party motor insurance, are clearly marked. Caravan-specific sections cover elements such as the hitch, overrun brake, mover, and trailer regulations.

Private sale or consumer sale?

The agreement begins with the parties indicating the applicable purchase situation.

Private individual to private individual: The Sale of Goods Act (1990:931) normally applies as supplementary law. Since the Sale of Goods Act is dispositive, the written agreement is of great importance.

Trader to consumer: The Consumer Sales Act (2022:260) applies. It is largely mandatory for the benefit of the consumer.

Three-year liability for defects in consumer sales

In consumer sales, the trader is responsible for original defects that manifest within three years after delivery. A defect that appears within two years shall, as a general rule, be considered a defect for which the trader is responsible, unless the trader proves otherwise or this is incompatible with the nature of the product or the defect.

A complaint made within two months of the consumer noticing the defect shall always be considered timely.

“As is” condition in private sales

In private sales, the parties may agree that the vehicle is sold “as is” (in its current condition). Such a clause does not, however, mean that the seller is automatically free from liability. According to the Sale of Goods Act, the vehicle may still be considered defective if, for example, the seller has provided incorrect information, failed to disclose a significant known condition, or if the vehicle is in significantly worse condition than the buyer could reasonably have expected.

Vehicle identity and registration details

The template includes separate fields for, among other things:

  • first registration date,
  • odometer reading for motorhomes,
  • gross weight, curb weight, and max load,

The Swedish Transport Agency recommends that the buyer checks the vehicle's debts and status before purchase. Vehicle-related debts may include vehicle tax, congestion tax, parking fines, and infrastructure charges.

Although the new owner does not become personally liable for the previous owner's debts, the vehicle may be affected by factors such as use bans and, in certain situations, seizure. The template therefore includes a specific checklist where the seller and buyer document this check.

Financing, leasing, and reservation of title

The agreement has a specific section to document whether the vehicle is subject to:

  • leasing,
  • installment plans,
  • vehicle financing,
  • reservation of title,
  • other security interests or encumbrances.

If such financing exists, the parties can specify exactly how and when it is to be settled.

Purchase price, down payment, and payment

The agreement includes clear fields for:

  • total purchase price,

  • remaining balance,

  • payment method,
  • VAT where relevant.

Service and vehicle history

For motorhomes, fields include odometer reading, service book, last service, timing belt/drive belt, engine, transmission, brakes, and chassis.

  • previous use,
  • tires and rims.

Living area – often missed in standard car contracts

Motorhomes and caravans carry a completely different risk profile than standard passenger cars. Therefore, the template contains an extensive living area section for:

  • previous moisture repairs,
  • roof hatches, windows, and seals,

Buyer’s inspection

The buyer can document that they have been given the opportunity to:

  • test drive the motorhome,
  • check the caravan's chassis, brakes, and hitch,
  • test the living area installations,
  • carry out a moisture inspection,
  • engage an independent workshop or inspector,
  • review service and repair history.

Change of ownership at the Swedish Transport Agency

Individuals can in many cases report a change of ownership via the Swedish Transport Agency's "My Pages." When at least one party is a business, the change of ownership must normally be made on the most recently issued registration certificate, part 2.

In the case of a written notice, the change of ownership must reach the Swedish Transport Agency within ten days for the specified transfer date to normally be registered as the official date of ownership change.

Third-party motor insurance – difference between motorhome and caravan

If a motorhome is taxed (on the road), or is to be taxed in connection with the change of ownership, the new owner must have third-party motor insurance from the registered date of ownership change.

A caravan is normally a trailer and does not require its own third-party motor insurance. Separate property insurance may, however, be relevant.

Handover protocol included

The agreement includes a separate handover protocol where the parties can check off items such as:

  • registration certificate and vehicle details,
  • keys,
  • service history,
  • instruction manuals,
  • moisture report,
  • repair receipts,
  • LPG details,
