About this template
Power of Attorney for property sale with two owners – Word, PDF and Excel
Are two co-owners going to sell a property but unable to both be present at the signing of the agreement? With this document package, the owners can draw up a specific written power of attorney for the sale of real estate, with clear limits on who may represent whom, which property is involved, the minimum selling price, and which documents the agent is permitted to sign. The option where only one co-owner needs an agent is also included.
Important legal information – real estate conveyance
A power of attorney to sell real estate must be in writing and expressly include the conveyance of the property, in accordance with Section 27, second paragraph of the Contracts Act. A property power of attorney is not a purchase agreement or a deed of sale. The deed of sale is subject to separate formal requirements in Chapter 4, Section 1 of the Land Code.
Two registered owners: If the same person is to represent both sellers, authorization must be granted by both. One co-owner's power of attorney does not automatically provide the right to convey the other co-owner's share. The Swedish Mapping, Cadastral and Land Registration Authority (Lantmäteriet) normally requires two witnesses to the seller's signature on the deed of sale for registration of title – this should not be confused with a general witness requirement for the power of attorney itself.
Verify original documents, any spousal/cohabitant consent, and the bank's/broker's procedures in advance. An application for registration of title, even when made digitally, assumes that the underlying conveyance document has been drawn up with valid signatures.

When is this power of attorney suitable?
For two private individuals who co-own a Swedish property and want to give a trusted person the right to manage specific actions during the sale. This may apply to negotiations with buyers and brokers, signing purchase agreements and, if explicitly stated, also deeds of sale. The power of attorney is intended for real estate, not for a tenant-owned apartment (bostadsrätt), which is a different type of right.
Two possible setups
1. The same agent represents both owners
Both co-owners are listed as principals and sign separately. Property designation, ownership shares, minimum price, and the scope of the power of attorney are specified in the joint document.
2. Only one owner needs a power of attorney
A co-owner can appoint an agent for their own share, while the other co-owner participates in the sale themselves or provides a separate power of attorney. The template is designed to avoid the agent appearing authorized for more shares than the assignment intends.
How do I fill in the template?
- Check the current registration of title, each owner's ideal shares, and the complete property designation including the municipality.
- Choose a joint or individual power of attorney and fill in all parties and the agent.
- Mark exactly which documents the agent is permitted to sign; state the minimum selling price and validity period.
- Investigate any written consent from a spouse or cohabitant and check the instructions of the bank, broker, and Lantmäteriet.
- Sign in writing and handle the original according to the current reception process.
- Follow up on completion, deed of sale, any purchase deed, possession, and revocation using the Excel register.
Legal issues to verify
According to Chapter 4, Section 1 of the Land Code (1970:994), the deed of sale must, among other things, identify the property, state the purchase price and the seller's declaration of conveyance, and be signed by the parties or authorized agents. The requirements apply to the deed of sale regardless of how the power of attorney is designed.
Check any consent rules in Chapter 7, Section 5 of the Marriage Code and Section 23 of the Cohabitees Act. An ownership structure with two co-owners does not automatically resolve consent requirements from a spouse or cohabitant. In cases of conflict of interest, estates of deceased persons, underage owners, complicated loans, or unclear title registration status, a specialist should be consulted.
Frequently asked questions
Can one of two owners give a power of attorney for the entire property?
A co-owner cannot, solely through their own power of attorney, grant an agent the authority to represent another owner. Each involved seller must sign themselves or be represented on valid grounds.
Must a property power of attorney be in writing?
Yes, when an agent is to conclude an agreement on the purchase, exchange, or gift of real estate, a specific written requirement applies in accordance with Section 27, second paragraph of the Contracts Act.
Must the power of attorney have two witnesses?
There is no general statutory two-witness requirement for the standard power of attorney as such. However, the title registration procedure sets requirements for witnessing the seller's signature on the deed of sale. Check the recipient's practical procedures.
Can I sign the real estate purchase with BankID?
Lantmäteriet's current guidance states that the acquisition document must be signed in writing and may not be replaced by electronic signing. Digital application for registration of title means, instead, that a copy of a correctly signed original document can be attached.
What do I do if one of the owners wants to revoke?
Use the revocation document and follow the Contracts Act's provisions on how the revocation takes effect. Inform the agent, broker, and involved third parties, and handle the original power of attorney. One owner cannot unilaterally revoke the other owner's authority.
Is the English document valid in the UK or the USA?
No. It is an English-language template based on Swedish law and intended for Swedish properties.
