Short-term agreements, rental period, and security of tenure

Does the Private Rental Act apply to short-term vacation rentals?

No, not when the lease is actually for leisure purposes. This follows from Chapter 1, Section 3 of the Private Rental Act (2026:772). For rental agreements under the Land Code, Chapter 12 regulates, among other things, rental period, termination, access, and security of tenure. If the same property is effectively let for permanent residence, a different assessment is needed.

Does a fixed-term short-term agreement terminate automatically?

A fixed-term rental agreement normally terminates at the end of the rental period in accordance with Chapter 12, Section 3 of the Land Code, unless otherwise agreed. For rental relationships that have lasted longer than nine months consecutively, however, notice is required for the agreement to terminate. When notice is actually required, the notice period depends, among other things, on the contract duration and usage according to Chapter 12, Section 4. It is therefore not possible to state a single general notice period for all vacation bookings.

Does the guest have security of tenure?

According to Chapter 12, Section 45 of the Land Code, there is a special exception from the right to extension for leisure rentals that terminate before the rental relationship has lasted longer than nine months consecutively. However, it is the actual lease, usage, and time period that must be assessed, not just the name of the product.

Cancellation, right of withdrawal, and deposit

Is there a fourteen-day right of withdrawal for vacation accommodation?

No, there is no general statutory right of withdrawal for booked hotel or vacation accommodation. The Swedish Consumer Agency emphasizes that cancellation and changes depend on the booking terms. Terms must be clear and assessed against applicable mandatory law, especially when the landlord is a business operator. This does not mean that an arbitrary or unreasonable cancellation fee is always valid.

How is a deposit handled?

A deposit must be settled against actual, substantiated, and legally justified claims. Normal wear and tear is not automatically compensable. The template has separate documents for check-in, check-out, and documented settlement; disputed amounts are accounted for separately.

Can the landlord cancel the booking if payment is late?

Not without regard to contract terms and applicable legal rules. Avoid general wording that any payment delay always gives the right to immediate eviction. Contact the guest, document claims, and assess the correct legal basis before further measures.

Tax and VAT for short-term rentals

For the rental of a small house that is a private home for tax purposes, one may normally be entitled to a standard deduction of SEK 40,000 per year and, in addition, 20 percent of the rental income, provided that the rules in the Income Tax Act are met. Ownership shares and the tax status of the home can change the assessment.

Rentals that actually resemble hotel operations may be subject to 12 percent VAT, depending on, among other things, the activity of the business, the arrangement, and turnover. After HFD 2026 ref. 3, no general three-month limit should be used to determine if the business is hotel-like. The assessment is made based on all relevant circumstances. How to use the templates

1. Check that the rental is actually a vacation or leisure stay and who the contracting party is.
2. Fill in exact booking dates, arrival time, departure time, and number of guests.
3. Describe the accommodation, included areas, inventory, any additions, and known defects.
4. Determine total price, actual payment terms, and a clear, reasonable cancellation alternative before the guest books.
5. Fill in relevant safety instructions for the facilities that actually exist.
6. Sign the agreement and save the booking confirmation and any appendices.
7. Perform a check-in inspection with photos, keys, and any meter readings.
8. Document check-out, acknowledge actual payments, and make an objectively based deposit settlement.

Frequently asked questions about short-term agreements for vacation accommodation

Is this template the same as a standard rental agreement for a house?

No. It is specifically designed for booked leisure stays during defined dates, not permanent housing. For permanent rentals, a product-specific agreement should be used.

Must the agreement be in writing?

Verbal agreements can be binding, but a written agreement is important to show parties, property, time, price, cancellation terms, and what is actually included.

Does the guest automatically get everything back upon cancellation?

Not necessarily. Assess the booking terms and applicable law. The parties should be able to identify and understand the cancellation costs before the booking is accepted.

Are inventory list, check-in/check-out, and Excel included?

Can Excel determine VAT or notice periods?

No. Excel is a practical register for actual bookings, payments, and certain consumption calculations. VAT, legal deadlines, and disputes are assessed separately.
