Important from 1 July 2026: identify the correct Swedish regime first
The older product version mixed together the rules for subletting a tenancy and letting a privately owned home. Sweden's new Private Letting Act (2026:772) entered into force on 1 July 2026.
The new Act does not apply where the sublessor themselves holds the dwelling under a tenancy. A condominium or another privately owned home let by a natural person or estate may instead fall within the Private Letting Act if its statutory conditions are met.
The template therefore begins with a legal-regime selection block before the remaining terms are completed.
Subletting a tenancy
A primary tenant who allows another person to use the dwelling independently generally needs the landlord's consent. If consent is refused, permission may be sought from the Swedish Rent Tribunal where the statutory requirements are satisfied.
The primary tenant remains responsible towards the primary landlord for rent and for how the dwelling is used.
Letting a condominium
A condominium owner normally needs the condominium association board's consent for second-hand letting. If the board refuses, the Rent Tribunal can grant time-limited permission when the owner has reasons for the letting and the association does not have a justified reason to refuse.
Under the current 2026 wording, earlier second-hand lettings are only to be considered where they have occurred to a significant extent.
Rent for a sublet tenancy under Chapter 12
For a sublet tenancy governed by Chapter 12 of the Swedish Land Code, the rent may not exceed the primary rent plus permitted additions.
- Furniture and equipment: maximum 15% of the primary rent.
- Electricity, broadband, parking and other included services: no more than the sublessor's actual cost.
- Partial letting: the primary rent should be proportioned to the extent of the part actually let.
Rent under the Private Letting Act (2026:772)
For new agreements governed by the 2026 Private Letting Act, the rent must be agreed as a fixed amount. Certain consumption-based utilities can be charged separately in accordance with the Act.
The Rent Tribunal can review the rent using the new statutory comparison model. The repealed 2012 capital-cost model should therefore not automatically be used for new agreements entered after 1 July 2026.
The Act also allows index clauses subject to statutory notice and timing requirements. The previous rent must generally have applied for at least one year before an index adjustment can take effect.
Excess rent and repayment
For second-hand lettings governed by Chapter 12 of the Land Code, the Rent Tribunal may order repayment where rent received exceeded the lawful level. The statutory repayment rules can cover rent paid before the application, subject to the time limits in the Act.
If the subtenant has already moved out, the application is subject to a short statutory deadline. The included user guide highlights these deadlines rather than presenting rent disputes as automatic claims.
Term and notice
The agreement contains separate options for indefinite and fixed terms and avoids using one generic notice clause for every type of letting.
- Chapter 12 Land Code: an indefinite residential tenancy generally uses three months to a month-end. Fixed-term agreements can require notice depending on their duration and circumstances.
- Private Letting Act: a fixed-term agreement normally ends on the agreed end date. The tenant may always terminate to a month-end occurring at the earliest three months after notice. An indefinite agreement can also be terminated to a month-end at the earliest three months after notice.
Security of tenure
For a tenancy sublet under Chapter 12, the subtenant generally obtains security of tenure only after the second-hand letting has lasted for more than two consecutive years.
If the parties need a waiver, it should be made in a separately executed document using the correct Rent Tribunal form and procedure. The Private Letting Act does not use the same Chapter 12 security-of-tenure structure.
Late payment and early termination
Different statutory thresholds apply depending on the regime. Under Chapter 12, more than one week's delay in residential rent may constitute a forfeiture ground. Under the Private Letting Act, more than two weeks' delay is listed as a ground for the landlord to terminate early.
Eviction is not automatic. Cure, reinstatement, notice and procedural rules can still apply.
Deposit
The agreement includes a structured deposit section covering amount, payment date, permitted documented deductions and repayment. The deposit is not described as an automatic fee that the sublessor can keep at the end of the tenancy.
Condition report, inventory and keys
Move-in condition, inventory, known defects, keys and supporting photo/video documentation can be recorded in the agreement or attachments. This can materially reduce later disputes over damage and normal wear.
Use, occupants and further subletting
The template records permitted residential use, other occupants, pets, smoking and applicable house or condominium-association rules. It does not grant an unrestricted right to sublet or assign the dwelling onward without the legally required consent or permission.
English primary – Swedish reference included
The English agreement is the primary version in this product. The Swedish version is included as a reference. Both versions are structured around Swedish law.
This is not a UK or US sublease template. English terminology is used to make the documents easier to work with internationally, but the governing legal framework is Swedish.

When individual advice is particularly appropriate
Individual legal advice is particularly appropriate for long sublettings, several rented dwellings, uncertainty about the governing regime, high rent, permission disputes, security-of-tenure issues, forfeiture/eviction or substantial damage claims.

Frequently asked questions
Does the Private Letting Act apply when I sublet my tenancy?
No. The 2026 Act expressly excludes situations where the person letting the dwelling themselves holds it under a tenancy. Chapter 12 of the Land Code is then the starting point.
Can I add 15% for furniture?
For a sublet tenancy under Chapter 12, the addition for furniture and other equipment may not exceed 15% of the primary rent.
Can a subtenant recover excess rent?
Yes, where Chapter 12 repayment rules apply, the Rent Tribunal can order repayment of rent received above the lawful level subject to the statutory conditions and deadlines.
Do I need permission even if no rent is charged?
Potentially yes. Independent use of a tenancy or condominium can constitute second-hand letting even where the payment arrangement is different or no rent is charged. Permission rules should therefore be checked separately from rent rules.
Are the rules the same for a tenancy and a condominium?
No. Permission, rent rules and security of tenure can differ materially. This is why the new template begins by identifying the type of dwelling and governing Swedish regime.
This package is a general documentation aid governed by Swedish law and does not replace individual legal advice.
