About this template

Easement agreement – template for contractual easements in Word and PDF. Do two property owners need to document a lasting right to use a road, well, utility line, or other specific area on another property? This package contains a structured Swedish grant deed, area annex, maintenance annex, registration checklist for Lantmäteriet, and a product-specific user guide. English reference versions are included, drafted in accordance with Swedish law.

Important: easements apply to properties, not people.

A contractual easement must provide permanent benefit to the dominant property and promote appropriate land use (Chapter 14, Section 1 of the Land Code). It cannot be used for a temporary, purely personal right of use. The agreement must be in writing, identify both properties and the purpose, and be granted through the signature of the owner of the servient property (Chapter 14, Section 5). Registration with Lantmäteriet is a separate step.

Legal review: October 10, 2026. Document version 2.0.

What is a contractual easement?

An easement is a right tied to the dominant property that burdens the servient property. It may provide a right to use a road or well to a certain extent, or otherwise occupy a specific area. The easement is not a general right to use the other property freely. It must be purposeful, have a permanent significance, and be sufficiently specified. According to Chapter 14, Section 3 of the Land Code, the easement cannot be transferred separately from the dominant property.

Contractual easement or official easement – what is the difference?

Contractual easements are established through an agreement between property owners according to Chapter 14 of the Land Code. Official easements are formed, amended, or revoked through an administrative decision as part of a cadastral procedure and are primarily governed by the Real Property Formation Act (1970:988). A privately signed document cannot create an official easement. In certain cases regarding roads, facilities, or utility lines, a joint facility or utility easement may be the correct instrument.

Formal requirements for easement agreements

According to Chapter 14, Section 5 of the Land Code, the contractual easement must be granted in writing by the owner of the servient property. The grant deed must specify the complete designation of both the dominant and servient property and the purpose of the easement. If these minimum requirements are not met, the document will not take effect as an easement. It is prudent to have all concerned property owners sign and to verify powers of attorney and co-ownership. Lantmäteriet states that the signature of the servient property owner is the formal requirement and recommends that other owners sign as well.

Location of the right and Annex A

For road easements, an actual map should mark the driving route, road width, connection, and any turning areas. For a well or utility line, the location, connection, and any pipeline route need to be delimited. Annex A is a form that the customer supplements with an actual property map or site plan. The illustrative images on the product page do not constitute accurate maps of any specific property. Unclear maps may lead to disputes or issues during registration.

Exercise, maintenance, and limitations

The easement must be used in a way that does not burden the servient property more than necessary (Chapter 14, Section 6). In Annex B, the parties can describe access, notification, repairs, damages, and restoration. According to Chapter 14, Section 1, an easement may not impose general labor obligations on the servient property owner; the law only permits specific maintenance obligations regarding roads, buildings, or other facilities. A clause that goes beyond this may affect whether the grant can be accepted as an easement.

Duration, transfer, and termination

Easements normally have no end date and follow the properties when ownership changes. It is therefore misleading to treat contractual easements as a common personal fixed-term usage agreement that can be terminated at will. The Land Code contains special provisions regarding correction, cancellation due to significant mismanagement or non-payment of compensation, consolidation of properties, and amendment or termination in certain cases. Check Chapter 14, Sections 7–14 and specific property formation rules before attempting to remove or amend a right.

Registration with Lantmäteriet

Registration in the Real Property Register provides important protection against future purchasers of the servient property. However, it is not in itself a general validity requirement for a correctly drafted contractual easement between the parties. Registration requires a separate application to Lantmäteriet with the easement document and any map material. Use the authority's current service or form. For postal applications, the contractual easement must normally be submitted in original; the rules for e-services differ. A joint property association may need to be handled through the constituent properties, not as if the association itself were a single burdened property.

How to fill out the easement agreement

  1. Check ownership, property designations, and existing easements with Lantmäteriet.
  2. Verify if the purpose is permanent and actually beneficial to the dominant property.
  3. Choose the correct grant instrument – contractual easement, official easement, utility easement, or other right.
  4. Fill in the complete name and owner information for both the servient and dominant property.
  5. Describe the right precisely enough so that there is no ambiguity regarding what, where, and for what purpose.
  6. Prepare Annex A with a real map and clear marking of the granted area.
  7. Regulate legal terms for careful use, access, and maintenance in Annex B.
  8. Check for any one-time compensation, payment terms, and other permitted conditions.
  9. Sign with the correct property owners and verify the authority of all representatives.
  10. Apply for registration if needed using the checklist in Annex C and the authority's current application.

When is the standard template not enough?

In cases of joint land, many co-owners, large utility installations, construction, complicated infrastructure, competing rights, property regulation, ongoing disputes, special permits, or uncertainty regarding easement requirements, a property lawyer or cadastral expert should review the matter. Rights to timber or grazing cannot be created as a contractual easement according to Chapter 14, Section 4.

Frequently asked questions about easements

Must the agreement be in writing?

Yes. According to Chapter 14, Section 5, a contractual easement must be granted in writing and clearly specify the servient property, the dominant property, and the purpose.

Do both parties need to sign?

For the formal requirements of the grant, the signature of the servient property owner is required. It is generally wise to have all concerned owners sign and ensure the right authority.

Does the easement follow the property when it is sold?

An easement is tied to the property, not the person. Registration has a special role for protection against future purchasers of the burdened property.

Can I end the easement with a normal notice of termination?

Not just like that. For termination, cancellation, and amendment, special rules apply that depend on the circumstances. A general unilateral termination clause should not be used habitually.

Can I use the template for fiber, electricity, or water and sewage?

In some cases, a contractual easement may be applicable. Larger or specifically regulated utility solutions may, however, require a utility easement, other permits, or other agreements. Assess the purpose and legal instrument before use.

Can one register the agreement with Lantmäteriet?

One can apply for registration of a contractual easement. This does not happen automatically when the parties sign the agreement. Annex C is a checklist, not the authority's form.

Is an English version included?

Yes. The English files are explicitly intended for Swedish law and should not be used as agreement templates under British or American law.
