Transport power of attorney – Word/PDF with Swedish and English guides

Do you need to let an employee, relative, or another person book a transport, drop off goods, or pick up a shipment on your behalf? With a transport power of attorney, you can document a clearly defined mandate for, for example, booking, dispatch, receipt, and transport administration.

When is a transport power of attorney used?

The template may be suitable when an individual or a Swedish company wants to let an agent handle a specific transport matter without giving general decision-making power over goods or finances. For example, an employee can be given the right to book the transport of identified parcels up to a maximum price and sign for receipt.

When is the template not sufficient?

A general transport power of attorney does not replace a consignment note, transport contract, identification, a carrier's specific power of attorney form, customs representative authority, dangerous goods documentation, or professional transport licenses. The sale or transfer of goods, credits, loans, bank withdrawals, and general settlement of damages are not covered as standard.

How is the document structured?

1. Principal and agent

You identify the principal and the person or company that will represent the principal. For companies, signatory rights should be checked separately.

2. Goods and transport

Document the assignment reference, sender, recipient, goods, number of packages, labeling, pickup and delivery address, carrier, and time period.

3. Authorizations and cost limitations

Only check the actions the agent is actually allowed to perform. Add caps for transport fees and additional costs, an end date, and explicit prohibitions against, for example, sub-delegation and entering into unwanted contract terms.

4. Goods control, receipt, and revocation

Use separate forms for receipt, damages, deviations, and for notifying in writing that the assignment has been revoked. These provide documentation support but do not replace the carrier's receipt or any legal notice requirements.

Important legal rules and limitations

Legal effects of the power of attorney under the Contracts Act

The Contracts Act (1915:218), specifically sections 10–27, contains rules regarding power of attorney, authorization, power, and revocation. It may be relevant whether an instruction is visible to the carrier or only provided internally to the agent. How revocation takes effect depends on how the power of attorney was issued and communicated; just a notice to the agent is not always sufficient.

Rules for domestic and international road transport

The Act (1974:610) on domestic road transport applies to certain paid road goods transports within Sweden with specific exceptions. The Act (1969:12) on international road transport and CMR may be relevant for international road transport. This power of attorney does not change liability under applicable transport legislation.

Customs representatives and import/export

In customs matters, the Swedish Customs Service distinguishes between direct and indirect representation. They have different roles and can have different consequences for customs debt liability. This template does not automatically grant the right to act as a customs representative and is not intended to be used as a complete customs representation mandate.

Professional goods transport

According to the Swedish Transport Agency, professional goods transport may require a license. A power of attorney does not grant such a license and does not relieve the transport company of any requirements.

Step by step: use the document package

1. Check the carrier's requirements. Ask if identification, a recipient code, a specific form, a consignment note, or an original power of attorney is needed.
2. Gather transport information. Note the goods, number of packages, sender, recipient, references, addresses, and transport date.
3. Select authorizations. Give only the rights needed for the transport matter.
4. Set a cost limit. Set a total cost framework and any separate framework for additional fees.
5. Sign. The authorized principal signs; check the recipient's own routines if any.
6. Document the handover. Use the goods receipt, photograph any damage, and save shipping documents.
7. End the assignment. Save the documents and, if necessary, use the revocation template and notify concerned parties.

Practical example: A company gives an employee the right to book transport for two pallets between two warehouses and pick up the goods. A maximum transport cost is specified, and the agent may not accept additional fees or waive claims for damages. This is only an illustrative example.

Frequently asked questions (FAQ)

Must both parties sign for the power of attorney to be valid?

The agent's signature is not a general formal requirement for all common transport powers of attorney under the Contracts Act. However, the recipient may require a specific receipt, identification, or have their own routines.

Are two witnesses required?

Normally, there is no general legal requirement for two witnesses for a standard specific transport power of attorney, but a recipient may set their own formal requirements to accept the document.

Can it be used to pick up packages at any agent?

No. Shipping companies and pickup locations may require their own form, code, or identification and may refuse a document that does not meet their requirements.

Can the agent clear goods through customs?

Not automatically. Customs representation can involve specific authority, declaration, and payment liability and must be handled separately according to current customs rules.

Can the transport power of attorney be revoked?

Yes, but the actions must be assessed according to the rules of the Contracts Act and how the original power of attorney came to the knowledge of the agent and third parties.

Is the agent allowed to receive or pay money?

This is not included automatically. It is advisable to specify separate payment routines and avoid unlimited rights to dispose of the principal's finances.

Is the English version internationally valid?

It is an English-language template designed according to Swedish law. It is not in itself a general international or foreign legal document.
