About this template

A property division template for cohabitants who agree on the allocation after separation. Record the home, household goods, debts and any balancing payment. The document is in English and downloadable after purchase.

Edit Word before signing, or print the PDF. PDF editing needs suitable software. Excel is also included. Adapt the document to your property and agreement.

Property division agreement or cohabitation agreement?

A property division agreement records the actual allocation after the relationship ends. A cohabitation agreement instead excludes division or specific property. Choose the document for the situation.

What does the template cover?

  • Names, personal identity numbers and contact details.
  • The home and household goods to be considered.
  • Debts, valuations and calculation of shares.
  • Who takes each asset, any balancing payment and payment terms.
  • Signatures. Witnesses are not a general requirement for this agreement.

What is included under Swedish cohabitation law?

Cohabitation property means the shared home and household goods acquired for joint use, subject to statutory and contractual exceptions. Cars, savings and shares are not included merely because you cohabit. Inheritances and gifts are not automatically excluded in every situation; conditions and use must be checked.

Division requires a request, normally within one year after separation; death has special rules. After debt deductions under Section 13, the remaining value is generally shared equally, subject to adjustments. Distinguish the property situation when the relationship ended from the valuation itself.

How to use the template

  1. Identify when the relationship ended and check the deadline.
  2. Identify cohabitation property and any cohabitation agreement.
  3. Record debts, valuation method and valuation date.
  4. Agree asset allocation, balancing payment and practical steps for the home and loans.
  5. Both read and sign, and keep a copy.

Simplified example

If the net value after proper debt deductions is SEK 300,000, and no exception or adjustment applies, the usual share is SEK 150,000 each. Assets need not be physically divided. This example does not decide which debts or assets belong in your case.

Check the home and loans before signing

The agreement does not automatically release a co-borrower from liability to the bank. Taking over a property may require registration of title and supporting documents. Seek advice for disputes, death or complex housing and debt matters. The template does not replace individual advice.

Common questions

Is this free?

No. This is a paid template; the current price is shown by the purchase button.

Must it be witnessed?

There is no general witness requirement. When you divide property yourselves, the document must be written and signed by both.

Must it be registered with the Swedish Tax Agency?

Division under the Cohabitees Act cannot be registered in the Tax Agency's marriage register. Property transfers may require steps with Lantmäteriet.

Is all jointly owned property included?

No. Joint ownership and cohabitation property are different matters. Other property may need a separate arrangement.

Is the valuation date always the separation date?

No. The date determining the property situation differs from the question of its value. Record the valuation method.
