About this template

Stormwater Facility – Operating Agreement, Inspection and Cost Register

For those who manage an existing private stormwater facility, it is important to know which manholes, pipes, ditches, and outlets are actually included, who is responsible for inspection, and how a suspected deficiency should be followed up. This document package contains editable Word templates, searchable PDF versions, and an Excel register for a practical, traceable operating organization.

The package helps, for example, property owners, smaller property managers, and authorized decision-makers in road cooperation or joint property associations to document a facility that has already been clearly defined. It is not a permit to install or modify stormwater pipes, dig new ditches, move outlets, or divert water onto a neighbor's property. Legal basis, regulatory review, professional competence, and valid cost allocations must be checked separately.

01. Package Contents

15 files in a ZIP: 7 editable Word (DOCX), 7 corresponding searchable PDF (A4), and 1 Excel (XLSX). Five Swedish work templates, one substantial Swedish guide, and an English User Guide. The main forms are in Swedish; the English guide is not an English version of the agreement.

Jurisdiction: Sweden · Version: 1.0, 27 October 2026 · Format: DOCX/PDF/XLSX · Delivery: digital ZIP download after purchase and correct file linking.

02. What the Files Contain – Detailed File List

Documents 01–07 are available in both Word and PDF and correspond to the actual file names in the package. Document 08 is the Excel workbook.

What problems do the documents help address?

Unclear responsibilities: the inventory identifies the facility, property designations, decision document, and contact person. Lack of inspection: the protocol distinguishes between inspected, deficient, and uninspected parts. Blockages and flooding: the deviation log helps record observations, affected areas, and follow-up. Disputed maintenance costs: the work order links the cost to an actual action and an authorized decision reference.

Excel Tool – Nine Tabs

Overview compiles data using formulas. Facilities records objects, land, and rights checks. Parties documents the role and basis for decisions. Inspection documents actually inspected components. Work calculates labor hours × hourly rate + material cost. Deviations tracks deficiencies and action status. Cost allocations checks that the three specified allocations sum to 100%. Allocation can distribute a separately decided cost according to these allocations. Read me contains instructions, examples, and public sources.

Excel cannot establish actual conditions, approved water classification, liability for damages, or new legal allocation ratios. Amounts are for administrative purposes only. VAT and contractual payment basis must be assessed separately.

Workflow – From Inventory to Completed Work

  1. Check existing rights: property boundaries, easements, rights of way, regulatory acts, responsibility under connection to a public water and sewage facility, and actual decision-making authority.
  2. Identify the facility components: pipes, manholes, open ditches, outlets, detention areas, and actual access. Document the map, photo ID, and what cannot be inspected.
  3. Assess water and environmental regulations: is it stormwater, wastewater, or a question of land drainage/water activity? A new outlet, deepened ditch, or altered flow requires a separate assessment before ordering.
  4. Document actual inspection findings: sediment, blockages, backwater, erosion, visible damage, and insecure covers or slopes. Do not report uninspected underground pipes as defect-free.
  5. Decide, act, and verify: specify the authorized requester, quote, professional method, any regulatory contact, invoice, post-work inspection, and open/protected deviation.

Important Swedish law: classification and permits

The Land Code, Chapter 3, Section 1 means that reasonable consideration must be shown to the surroundings when using immovable property. During excavation and similar work, protective measures under Chapter 3, Section 3 may become relevant. The Supreme Court case T 3372-20 addresses the relationship between the inspection of a stormwater pipe and damage to a neighbor. The ruling does not mean that every flood automatically leads to damages, but shows why actual risks and reasonable inspections are important.

Responsibility for stormwater: The Swedish Transport Administration's guidance distinguishes between an individual property owner's water and sewage installation and the connection point to a public facility. The Swedish Environmental Protection Agency describes when stormwater can be treated as wastewater and how this differs from land drainage. Not all ditches that carry rainwater are land drainage ditches. New work, expansion, or altered diversion must never be assessed solely based on a glossary in this template.

Joint property association: The Swedish Land Registry's facility decision specifies the purpose, participants, and allocation ratios for, for example, construction and operation. A private operating agreement or percentage in Excel does not change these decisions. If the legal basis, boundary, or need for a new purpose is unclear, the association must examine the matter separately.

Technical work and safety: the documents are not design documents, flow calculations, or instructions for hazardous excavation or manhole work. Contact the relevant water and sewage authority, municipal environmental department, County Administrative Board, Swedish Land Registry, or technical/legal specialist as needed. In case of suspected contamination or significant risk, the local regulatory authority should be contacted based on the circumstances.

Frequently Asked Questions

Can I build a new stormwater ditch with this agreement?

No. The template is intended for the maintenance and documentation of an already existing, legally defined facility. New excavation, deepening, or altered outlet may require a separate land, water, or environmental review.

Does the agreement create a right to divert rainwater to the neighbor?

No. The right to use another's land or divert water over it must be substantiated in another correct way. A Word document cannot replace decisions or permits required by law.

Can a joint property association determine new allocation ratios in Excel?

No. Excel only calculates an allocation based on the specified model. For a joint property association, decided allocation ratios and special rules for any changes apply.

What inspection frequency is required by law?

No general fixed interval is specified in this package. Scope and frequency must be assessed based on the facility's condition, risk, design, and relevant decisions. Material deficiencies must be investigated when there is reason to do so.

Are all PDF files editable, and are there English agreements?

The PDF files are searchable and printable. The DOCX files are editable. The five work templates are in Swedish, and a separate English user guide is included; no interactive PDF forms or English main agreements are provided.
