About this template
Production and production orders in litigation – documents, evidentiary issues and production register. A professional document package for parties in Swedish civil litigation who wish to prepare a precise application for an order requiring a party or third party to produce an identified document of evidentiary significance. The package helps you document the identity of the documents, the likelihood of possession, relevance, exceptions and the court's actual decision.
Important legal distinction: These are private preparatory templates, not an official court form and not a production order. The court decides whether documents are to be produced. An application is not a general right of access to the opposing party's systems and does not automatically entail a penalty or enforcement.
When is an application for production relevant?
When a specific identifiable document, such as an agreement, a business document, a log file or electronic communication, can be considered to have evidentiary significance in a specific litigation case. According to Chapter 38, Section 2 of the Swedish Code of Judicial Procedure, the holder may be obliged to produce the document, subject to the exceptions provided by law. The court may order the holder to produce the material under Chapter 38, Section 4.
01. Package contents
15 ready-made client files: 7 editable Word templates (.docx), 7 corresponding searchable PDF files and an Excel workbook (.xlsx) with nine tabs. The operational documents and the Swedish user guide are in Swedish; a separate English User Guide is included. Delivery format is ZIP.
02. What the files contain
A ready-made document for an application for production, specification of the requested documents, analysis of evidentiary issues and relevance, verification of possession, third parties and possible exceptions, as well as a compliance log for actual court decisions. The Excel register helps to keep requested documents, decided obligations and actually received material separate.

Excel register with nine tabs
Overview, Cases, Documents, Evidentiary issues, Possession, Objections, Decisions, Events and Read me. The overview shows, among other things, the number of registered cases, identified documents, requested and received documents and actually registered decisions on approval. The status fields are entered manually and the formulas only count administrative entries.
The register cannot determine whether production is permitted, whether a certain document is covered by confidentiality, whether evidence is sufficient, whether the court should issue a penalty or when an order is to be fulfilled.
How to use the templates – step by step
- Identify the disputed factual issue in the ongoing case and why a certain document has evidentiary significance.
- State as precisely as possible which document or delimited set of documents is intended, including time period, identifiers and format.
- Explain what the document is intended to prove with a separate evidentiary issue per document or document group.
- Describe concrete circumstances that indicate that the production respondent possesses the document. This may apply to a party or third party.
- Consider applicable exceptions, confidentiality, secrecy and privacy or trade secret interests. Make a genuine assessment of relevance and proportionality.
- Prepare the application for production and submit it to the correct court according to the instructions of the relevant case and the court.
- Wait for the court's actual decision. Record approval, rejection and compliance only if they have actually occurred.
- List the received material, its origin, file format and any limitations before it is cited as evidence.
The law behind production orders
Possession and evidentiary significance
Chapter 38, Section 2 of the Swedish Code of Judicial Procedure contains the general rule on the obligation to produce, including special exceptions. From the Supreme Court's decision Ö 4651-21, it appears that a production order presupposes, among other things, that the document can be identified, can be considered to have evidentiary significance and is in the possession of the person against whom the order is directed. A balancing of interests may also be required.
Electronically stored documents
Production may include electronically stored data and an order may, in applicable cases, refer to an electronic format. Read the Supreme Court's guidance on electronically stored information. The package does not, however, presuppose that every IT system or all data must be produced.
Decisions, penalties and other coercive measures
According to Chapter 38, Section 4, the court may decide on a production order. Rules on penalties and production through the Swedish Enforcement Authority are found in Chapter 38, Section 5, but such measures require actual legal examination and a decision; they are not created by a filled-in template.
Common questions about production
What is a production order?
A court decision that a person or company shall produce a written document that may have evidentiary significance, if the court's requirements are met.
Can I demand to receive all of the opposing party's emails?
Not generally. An application for production must refer to identifiable documents or a sufficiently delimited group and must be explained based on evidentiary significance and other legal requirements.
Can even a third party be obliged to produce?
Yes, the obligation to produce may include a third party who possesses a relevant document. Applicable exceptions and the court's examination must be considered.
Does production also apply to files and electronic data?
Yes, in some cases. Swedish case law also deals with electronically stored documents and that production can be done digitally.
Must trade secret documents always be produced?
No. Protected data and other exceptions require a special legal assessment. It is not sufficient that a party simply wants more information.
Is Excel an automatic application to the court?
No. The register is only an administrative support. It does not send any documents and contains no automatic legal decisions.
