About this template

Proof of claim and monitoring in bankruptcy – complete template package for creditors. Document a claim, state the basis of the debt, compile the amount and attachments, check any security or preferential rights, and follow up to see whether formal monitoring proceedings have been initiated. The package contains editable Word files, searchable PDF files, and an Excel register with nine tabs.

Important legal distinction: It is not the same to submit a claim to the bankruptcy trustee in a bankruptcy without formal monitoring proceedings as it is to submit a formal proof of claim after a decision on monitoring proceedings. Sending a document does not guarantee that the claim will be approved or that money will be paid out.

01. Package contents

15 customer files: 7 editable Word files (.docx), 7 corresponding searchable and printable PDF files (.pdf), and 1 Excel workbook (.xlsx) with 9 tabs. Five working documents plus a Swedish and English user guide in Word/PDF, and an Excel tool. Delivered as a ZIP.

02. What the files contain

Request and proof of claim to the bankruptcy trustee, formal monitoring letter, claim and interest schedule, security/preferential rights check, support for post-monitoring, two guides, and an Excel register. Excel shows administrative statuses and totals but does not determine legal preferential rights, payment, prescription, or deadlines.

Important bankruptcy rules 2026

From 1 July 2026: according to Chapter 9, Sections 1–6 of the Bankruptcy Act (1987:672), the bankruptcy trustee may decide on monitoring proceedings. In new proceedings, written proof of claim is submitted to the bankruptcy trustee and must state, among other things, the amount of the claim (if possible), the basis, any preferential rights, and any documents relied upon. The monitoring period is normally four weeks, and the trustee may decide on a longer period of up to eight weeks.

Transitional rules: monitoring proceedings initiated before 1 July 2026 may be subject to older procedural rules. Check who the recipient is and which deadline actually applies according to the announcement.

Without decided monitoring proceedings the creditor can normally submit information about their claim directly to the bankruptcy trustee within the scope of the investigation, according to the Swedish Tax Agency's legal guidance. The specific monitoring deadlines do not automatically apply to every bankruptcy.

Post-monitoring: if the formal deadline is missed, post-monitoring may sometimes be possible, but a state post-monitoring fee may be required. Kronofogden explains what you should do and how the fee is handled. Wait for the correct invoice and payment instructions.

Excel register with nine tabs

Dashboard, Claims, Creditors, Monitoring, Supporting Documentation, Preferential Rights, Communication, Deadlines, and Read Me. Excel uses formulas to calculate alleged capital amounts, stated interest, and fees, as well as registered statuses. Specifically, "Sent", "Received", and "To be monitored". Legal deadlines and preferential rights are not calculated or determined automatically.

How to work with the templates

  1. Check the bankrupt entity, bankruptcy trustee, bankruptcy case, and current announcement.
  2. Determine whether formal monitoring proceedings have been initiated and whether older transitional rules apply.
  3. Collect agreements, invoices, proof of delivery, and payment history.
  4. Describe the claim, amount, and any security with clear attachments.
  5. Send via the correct channel and document actual receipt and response.
  6. Follow up on the trustee's instructions and any formal deadlines.

Frequently Asked Questions

Must all claims be formally monitored?

No. Formal monitoring proceedings are decided separately and are not initiated in every bankruptcy. Contact the trustee if in doubt.

Should the claim be sent to the district court?

According to the rules for monitoring proceedings initiated from 1 July 2026, formal proof of claim is sent to the bankruptcy trustee. For older proceedings, applicable transitional rules and instructions should be checked.

What if I missed the last monitoring day?

Post-monitoring may be possible but is not always available. A fee may be charged. Check the status of the bankruptcy and ask the trustee before taking action.

Does Excel automatically grant the right to payment?

No. Excel is an administrative register, not a bankruptcy law decision engine.

Is an English monitoring form included?

No. An English User Guide explains the contents, but the Swedish application templates are in Swedish.

Are the PDF documents interactive forms?

They are searchable and printable. Edit the document text in Word.
