About this template

Have you ordered an item that never arrives or is delivered late? The package Delayed delivery of goods – delivery requirements, additional time, rescission and refund helps private individuals document a purchase from a company and present a clear, written demand. It contains five Swedish work templates and an Excel register to distinguish what has been ordered, what has actually happened, what has been claimed, and what has actually been paid.

For those who have purchased a physical item from a company. The documents are designed with the support of the Consumer Sales Act (2022:260). They are not an agreement between businesses, not a cancellation form for distance purchases, and not a tool for making a complaint about defects in an already delivered item.

01. Package contents

15 customer files: seven editable Word documents (DOCX), their seven corresponding searchable PDF versions, and an Excel workbook (XLSX) with nine tabs. Of the Word documents, five are Swedish work templates, one Swedish step-by-step guide, and one English user guide for the Swedish documents. All DOCX/PDF pairs have their own headings and clear areas of application.

02. What the files contain

Fields for seller, order number, purchase date, agreed delivery time, actual delivery, reasonable additional time, written delivery requirements, grounds for possible rescission, refund amount, substantiated additional costs, invoice details, communication, and evidence. Excel keeps claimed amounts, expenses, and actually received payments separate. No tool automatically determines legal validity, a reasonable deadline, or the right to damages.

When should you use the template package?

Example 1: You order a piece of furniture from a company with delivery promised on November 5. It does not arrive. You want to request actual delivery and receive written confirmation. Start with the delivery requirement.

Example 2: You have already made demands for delivery and now want to set a final date. Use the template for reasonable additional time, but determine the date according to the circumstances – no universal deadline of, for example, 7 days applies.

Example 3: The seller notifies that the item will not be delivered, or a reasonable additional time for the individual case has expired. Check the conditions according to Chapter 3, Section 5, and then, if the conditions are truly met, use the template for rescission and subsequently for a refund claim.

Not suitable for: cancellation of a functioning purchase without delay, defects in a delivered item, pure shipping disputes where a private shipping agreement applies, service agreements, B2B purchases, or questions about special digital services. There is a difference between cancelling, cancelling an order, making a complaint about defects, and rescinding due to delay.

How the Excel tool works – nine tabs

Read me, Overview, Cases, Orders, Events, Expenses, Claims, Communication, and Evidence. Register a secure case identity and manually verified facts. In the Expenses tab, actually paid compensation can be compared with manually substantiated costs. Example: 200 SEK in expenses and 50 SEK already actually compensated gives an administrative difference of 150 SEK. This does not mean that you have a legally established claim of 150 SEK. The example is tested and cleared from the delivery file.

The Overview shows the number of registered cases, substantiated expenses, claims, and actually received payments. There are no automatic decisions about grounds for rescission, deadlines, damages, or credit law objections. Personal identity numbers, full card numbers, and sensitive documents should not be placed in the shared register.

How to proceed – five steps

  1. Check the purchase. Confirm that you are a consumer, that the counterparty is a trader, and that it concerns a physical item. Get out the order confirmation and the actually promised delivery day.
  2. Document the delay. If there is no agreed delivery time, the item should normally be delivered without unnecessary delay and no later than 30 days. If a time was promised, the delivery should be compared with it. Normally contact the seller, not just the shipping company.
  3. Request delivery. Send document 01. If necessary, state a specific additional time that is reasonable in your particular case with document 02.
  4. Assess the right of rescission. The fact that the delivery was late does not automatically mean that the purchase can be rescinded immediately. Review the separate conditions in Chapter 3, Section 5, and then choose document 03 only when a valid ground exists.
  5. Follow up on payments. After a valid rescission, document 04 can be used to request the paid price back and separately any substantiated additional costs. If the invoice is not paid, document 05 can be used for a limited partial payment and appropriate contact with the invoice issuer.

The law – what does the Consumer Sales Act say?

When is a physical item considered delayed?

Consumer Sales Act (2022:260), Chapter 2, Sections 2–3, regulates when an item must be delivered and when it is considered delivered. In the absence of an agreed delivery time, the main rule is delivery without unnecessary delay and no later than 30 days from the agreement. The buyer's own separately arranged shipping can affect the assessment of when delivery has occurred.

Can I demand delivery or withhold payment?

According to Chapter 3, Sections 2–4, the consumer can generally demand performance in the event of the seller's delay and withhold as much payment as is necessary as security for the claim. There are special exceptions to the seller's obligation to perform, for example when performance is impossible or would require unreasonable sacrifices.

When can I rescind due to delayed delivery?

Chapter 3, Section 5 includes, among other things, delay of material importance, a delivery date expressly decisive before the purchase, the seller's notification that delivery will not occur, or that the item will not arrive within an additional time that is not unreasonably short. It can also become relevant after a reasonable time from a delivery requirement without a specific additional time. These alternatives are not identical, and the conditions must be checked individually.

When do I have the right to a refund?

After a valid rescission, the parties' continued delivery and payment obligations fall away, and received performances must be returned according to Chapter 8, Section 2. The refund must be made without unnecessary delay according to the provision. It is not the same legal rule as the special refund deadline in the Distance Contracts Act for the right of withdrawal. Damages for actual additional costs are assessed separately according to Chapter 6 and can be subject to exceptions and an obligation to mitigate the damage.

Common questions about delayed or missing delivery

What do I do if the seller says the package has been sent, but I have not received it?

Check the agreement's delivery method and who arranged the shipping. As a general rule, the seller is responsible for the delivery until correct delivery; therefore, direct the complaint to the seller, save the order and tracking details, and request a written statement.

Do I have to wait 30 days if another delivery day was stated in the purchase?

No. The deadline of 30 days is the main rule when the delivery time does not follow from the agreement. An actually promised delivery day is assessed according to the agreement and applicable law.

Are seven days always a sufficient additional time?

No. Chapter 3, Section 5 presupposes that the additional time is not unreasonably short. Assess what is reasonable in the concrete situation; Excel does not make that assessment.

Can I rescind immediately and request a refund?

In some situations yes, but not solely because the delivery day has passed. You must be able to attribute the circumstances to an applicable ground in Chapter 3, Section 5. Document the concrete facts that make the delay qualified.

Can I request compensation for extra shipping or a cover purchase?

Substantiated, reasonable, and directly attributable additional costs can in some cases be compensated according to the damage rules. Exceptions and the obligation to mitigate damage apply. Document actual costs and assess them separately from the refund of the original price.

What do I do if a separate invoice service requires payment?

Contact both the seller and the invoice service or the creditor. Explain in writing why you believe the delivery is delayed and how large an amount you are withholding or disputing. Ensure yourself that your objection reaches the right recipient; an email to the seller is not forwarded automatically.

Can I use the package for the right of withdrawal or already delivered damaged goods?

No. Those cases are regulated by other legal conditions. For a separate invoice dispute, the template Formal Dispute of Invoice – Private Individual may be relevant, but it does not replace the assessment of the delivery delay.
