Do you need to let someone else negotiate, buy or sell a specific car or manage a defined vehicle matter? This power of attorney for cars and vehicles provides well-developed documentation support to identify the grantor, the agent and the vehicle, as well as to regulate which actions the agent may perform.

What is a vehicle power of attorney used for?

With this template, an individual or a company can give a designated agent a limited assignment, for example to negotiate and sign a specific purchase agreement, check vehicle information, or hand over an identified vehicle. Specify the registration number, make, model and VIN so that the mandate can be linked to the correct vehicle.

Suitable for

• Selling a car when the owner cannot be present but wishes to limit the price and authority.
• Purchasing an identified vehicle with a maximum allowed purchase price.
• Company matters where an authorized signatory gives an employee a limited mandate.
• Documentation of receipt, payment control and handover.

When is the template not suitable?

The template is not a durable power of attorney, bank power of attorney, general power of attorney for all vehicles, or a form for the authority's change of ownership registration. It does not replace purchase agreements, financing or leasing consent, traffic insurance, inspection documentation, or specific documentation for import and export. Estates, co-ownership, guardianships and minor owners may require special authorization documents.

The legal framework of the power of attorney

Authority and power under the Contracts Act

The Contracts Act (1915:218), particularly sections 10–27, regulates, among other things, the scope and revocation of a power of attorney. It is important that the limits applicable to a counterparty are clearly stated in the documents shown to the counterparty. An important internal instruction is not always sufficient to prevent legal consequences if the agent acts outside their internal instructions.

Change of ownership at the Swedish Transport Agency is a separate process

A power of attorney does not mean that a change of ownership has been completed. The Swedish Transport Agency specifies separate notification channels and identity requirements. In the case of a change of ownership where at least one party is a company with an organization number, the change of ownership should normally, according to the authority's guidance, be notified using Part 2 of the most recently issued registration certificate. The e-service for individuals requires the logging-in seller to use their own e-identification. The agent must never use the grantor's BankID with the support of this template.

Registration certificate, debts, credit and leasing

Part 2 of the registration certificate is a document of value and only the most recently issued version is valid. When buying a car, the parties should also check vehicle-related debts, usage prohibitions, inspection status, credit reservations and leasing listings. The Sale of Goods Act and the Consumer Sales Act

For private purchases, the Sale of Goods Act (1990:931) is often relevant unless otherwise agreed. When a trader sells a car to a consumer, the Consumer Sales Act (2022:260) normally applies, even for used vehicles. The power of attorney does not give the right to bypass consumer protection. Revocation

The revocation of a power of attorney may require that the original written document be retrieved or that relevant third parties be notified, depending on the type of power of attorney and how it has been displayed. See in particular sections 12–19 of the Contracts Act. A specific revocation template and checklist are included.

How do you fill out the power of attorney?

1. Identify the grantor and the agent. Provide full details and check for any right of signatory.
2. Describe the vehicle. Use registration number, make, model and VIN.
3. Select assignment. Limit to purchase, sale or a specified administrative action.
4. Determine financial limits. Specify maximum purchase price or minimum sales price as well as maximum expenses.
5. Mark authorities and limitations. For example, negotiation, signing, handover and explicit exception for credit or bank accounts.
6. Sign and handle authority requirements separately. Check the counterparty's routines, registration certificate and correct change of ownership method.
7. Document closure. Use the handover protocol and register status in Excel without storing unnecessary personal data.

Practical example: An owner gives a relative the right to sell a certain car for a price of at least SEK 85,000. The power of attorney identifies the car and states that the purchase price must be paid directly to the seller before the keys are handed over. The agent is not allowed to take out loans, dispose of bank accounts or use the seller's e-identification. The amount is illustrative only.

Common questions about power of attorney for cars and vehicles

Can I complete the change of ownership with this power of attorney?

It may be relevant for certain civil law assignments but is not an automatically accepted alternative to the Swedish Transport Agency's own identity, signing and notification requirements. Check the current method with the authority.

Does the power of attorney need two witnesses?

There is no general requirement for two witnesses for a standard specific vehicle power of attorney under the Contracts Act. A specific recipient may nevertheless request their own form or special identity verification.

May the agent use my BankID?

No. The document does not provide the right to use anyone else's BankID or personal login credentials.

Can the agent receive money or arrange financing?

Not according to the template's standard limitations. Payment is regulated separately and should normally be made directly to the party of the agreement. Loans, leasing and credits must be assessed separately.

Do I need a purchase contract too?

Yes, normally the transaction should be documented separately. The power of attorney is not the agreement that regulates the vehicle's condition, price, liability and payment between the seller and the buyer.

What does the Excel file do?

It registers vehicle assignments, mandate limits, checks, status and discrepancies. It makes no legal decisions and sends no change-of-ownership notifications.

Can the template be used for motorcycles and other registered vehicles?

It can be adapted for another identified motor vehicle, but specific authority requirements, vehicle categories and insurance rules must be checked in each case.

Is the English version an international power of attorney?

No. It is an English-language template based on Swedish law and provides no guarantees regarding the acceptance by foreign recipients.
