About this template
Rental Agreement for Movable Property – Word/PDF for machinery, tools, inventory, and other equipment. Are you renting out items such as a camera, trailer, audio equipment, or tools? A clear written agreement allows you to document the rental items, compensation, rental period, deposit, pre-documented condition, liability for damages, and how the item is to be returned. You receive a main Swedish template, three practical annexes, a detailed user guide, and English reference documents governed by Swedish law.
For the rental of movable property, there is no general Swedish law regulating all matters in the same way as residential leases. The parties' agreement and general contract law are therefore central. When a company rents to a consumer, applicable consumer protection regulations must also be considered. The Consumer Sales Act primarily applies to the sale of goods, not as a general law for this type of rental.

What is a rental agreement for movable property?
It is an agreement stating that a party may use a specific item for a period of time in exchange for compensation, without ownership being transferred. Examples include the temporary rental of machinery, cameras, furniture, scaffolding, and other movable equipment. In legal terminology, "movable property" can be broader than physical objects; this template is intended for identifiable physical objects, not, for example, licenses, securities, or intellectual property rights.
Rental period and termination
The template distinguishes between fixed-term with an explicit end date and open-ended rental with a separately agreed-upon notice period. The rules regarding a three-month notice period for residential leases cannot be mechanically copied to the rental of tools or inventory. Also describe whether the rental period can be extended, what applies in the event of a delay, and how notices must be sent so that receipt can be proven.
Rent, deposit, fees, and VAT
Specify rent per day, week, or other chosen period, payment method, due date, total price, and whether VAT is included. A deposit is a security, not a pre-earned fee or an automatic penalty. If the lessor wishes to make a deduction, it must be specifiable and supported by reasonable documentation and legal grounds. Withholding a refund must be explainable.
VAT: For taxable rentals of movable items in business activities, VAT is normally 25 percent. Occasional private rental is not automatically considered taxable business activity. The Swedish Tax Agency states that income from private rental of cars, boats, or objects is normally included in the income category of capital, and that frequent rental may entail VAT or business taxation. A current check is necessary in each case.
Inventory, damages, and normal wear and tear
Annex A identifies the item with a serial number, model, and accessories. Annex B makes it possible to compare the condition upon handover and return, with dated photos and protocols. Annex C makes it easier to document whether the deposit has been refunded in full or if a substantiated deduction has been made.
Not all damages can automatically be charged to the lessee. A problem may stem from previous defects, normal wear and tear, lack of instructions, improper use, or an unforeseen event. Liability, costs, and potential compensation depend on the agreement, circumstances, evidence, and applicable law. The lessor should not demand double compensation for the same loss through, for example, both full replacement and repair.
Insurance, security, and permitted use
Before renting out, check if existing insurance actually covers the item being rented to someone else. Insurance terms may limit which users, areas of use, and deductibles are covered. The lessor should provide sufficient safety instructions and disclosures regarding known defects. For vehicles, boats, work machinery, and special technical equipment, there may also be specific authorization, insurance, and regulatory rules.
What laws apply to the rental of movable property?
In private rental, the parties' agreement is particularly significant because no comprehensive special law generally regulates the rental of physical objects. The Contracts Act (1915:218), including Section 36 regarding unfair terms, may be relevant. When renting from a business to a consumer, the Act (1994:1512) on Contract Terms in Consumer Relations also applies. For certain distance contracts or contracts concluded off-premises, the Act (2005:59) becomes relevant.
Agreed right of withdrawal should not be confused with the statutory right of withdrawal. For distance contracts, there is normally a 14-day consumer protection period where the law is applicable, but there are exceptions. For example, car rental for a specific date or period is covered by an explicit exemption from the right of withdrawal. Therefore, different types of rentals require different checks.
How to use the document package – step by step
- Check the parties: is the lessor a private individual or a company, and is the lessee a consumer or a business owner?
- Identify the item: note the make, serial number, and accessories in Annex A.
- Document the condition: take dated photos and note existing remarks.
- Choose rental period: specify fixed-term or open-ended rental with notice period.
- Fill in rent and deposit: clarify if VAT is included and when the deposit is to be refunded.
- Check security and insurance: note usage limitations, instructions, and insurance terms.
- Execute handover: fill in Annex B and have the parties sign for the actual handover.
- At return: document functionality, accessories, and any deviations.
- Perform final settlement: account for and justify every deduction in Annex C and refund the rightful amount.
- Archive: save agreements, photos, payment receipts, and protocols securely.
When is a special template better?
When renting out a passenger car or boat, the agreement often requires specific rules regarding driver authorization, traffic insurance, mileage, fuel, maritime safety, and liability in case of accidents. In those cases, use a more object-specific template or supplement this one with professionally designed special terms. This standard template is not intended for real estate or residential leases, leasing with a purchase option, or international rentals with complex tax and liability structures.
Frequently asked questions
Can I use the template when renting out tools as a private individual?
Yes. It is intended for the temporary letting of physical objects and contains specific support for condition, deposit, and return.
Is there a statutory notice period?
There is no general notice period for all rental agreements for movable property equivalent to the rules for residential leases. Determine and document applicable terms and check consumer rules if necessary.
May the lessor keep the deposit if the object breaks?
Not automatically. The cause of the damage, normal usage, the agreement, actual loss, and the reasonableness of the deduction need to be reviewed.
Must I add VAT?
It depends, among other things, on whether the rental is conducted as a business activity and on applicable rules regarding VAT registration and exemptions. For taxable rentals, the rate is normally 25 percent.
Does the customer always have a 14-day right of withdrawal for online bookings?
No. The right of withdrawal depends on the type of agreement and the law's exceptions. Car rental for a specific period is an example where the statutory right of withdrawal is normally excluded.
Do the parties need to sign the inventory annex?
It is recommended in order to document which item and which accessories were included. Annexes and photos should be clearly linked to the main agreement.
Is an English version included?
Yes, all five documents are available as English reference versions under Swedish law. They are not general legal templates according to British or American law.
