About this template
Complaint of miscarriage of justice – application, gross procedural error and evidence
A complete set of Word, PDF and Excel templates for anyone wishing to investigate whether a final judgment from a Swedish court of general jurisdiction can be set aside on the grounds of miscarriage of justice. The package helps you identify the correct point in Chapter 59, Section 1 of the Swedish Code of Judicial Procedure, describe the concrete procedural error, distinguish between finality and knowledge, and check evidence, submission and the court's actual decision.
Important legal distinction: Miscarriage of justice is an extraordinary remedy. Dissatisfaction with the assessment of evidence or a substantive legal ruling does not in itself constitute miscarriage of justice. A complaint is not an ordinary appeal, not an application for reopening, and not a restoration of time lost. The package consists of private work templates, not official court forms or individual legal advice.
01. Package contents
15 customer files in ZIP: 7 editable Word templates (.docx), 7 corresponding searchable PDF files (.pdf), and 1 Excel register (.xlsx) with nine tabs. The operational templates and Swedish guide are in Swedish; an English User Guide is included separately. The PDF files are not interactive official court forms.
02. What the files contain
A written complaint of miscarriage of justice, a legal basis matrix for procedural impediments, lack of service, unclear judgment or other gross procedural error, a basis for documenting the party's position and actual knowledge, a manual time limit and court check, an evidence and decision log, and two user guides. Excel keeps alleged error, proven event, submitted document and actual court decision separate.

Excel register with nine tabs
Overview, Cases, Grounds, Service, Time Limits, Evidence, Submission, Decisions and Read Me. Register your own cases and supporting documents, distinguish the invoked ground for miscarriage of justice from the procedural documents and save actual court receipts. The dashboard shows the number of manually registered cases, grounds, evidence and verified submissions. The customer version is empty of test entries.
Excel does not make a legal assessment: No formulas determine miscarriage of justice, remedy, competent instance, finality, date of knowledge, statutory deadline, stay of execution or approval.
Four grounds for miscarriage of justice – Chapter 59, Section 1
1. Procedural impediment
If the case was heard despite such a procedural impediment that the higher court would have considered ex officio in an appeal. Identify the impediment and its procedural consequence.
2. Lack of summons or prejudice to a third party
If the judgment was given against someone who had not been properly summoned and had not either pleaded the case, or if a third party who had not been a party suffers prejudice through the decision. Document actual service, party position, knowledge and consequence.
3. Unclear or incomplete judgment
If the judgment is so unclear or incomplete that it is not apparent how the court ruled in the case. Point out the concrete lack of clarity and identify the operative part of the judgment.
4. Other gross procedural error
If another gross handling error can be assumed to have affected the outcome of the case. Describe exactly which procedural rule was disregarded and how the error may have influenced. If a circumstance has not been invoked earlier, there is a special limitation according to Chapter 59, Section 1.
How to prepare a complaint of miscarriage of justice
- Obtain the final judgment, case number, all relevant protocols, service details and the court's instructions.
- Determine whether the situation really concerns a ground for miscarriage of justice according to Chapter 59, Section 1, rather than an ordinary appeal or reopening.
- Choose the relevant point 1–4 and state the concrete procedural error as well as the invoked documents and their evidentiary value.
- Check whether there are special limitations for a new circumstance under point 4.
- Determine the start of the time limit according to the chosen ground, not through a general date formula. Points 1 and 4 are normally covered by six months from finality, while point 2 has special rules from knowledge of the judgment.
- Check the correct appellate court: a complaint against a district court decision is submitted to the court of appeal; a complaint against a court of appeal decision to the Supreme Court according to the general rule.
- If enforcement must be stayed: investigate the need for a special request according to Chapter 59, Section 3. The complaint does not automatically stop enforcement.
- Submit a correctly signed document in good time, keep the actual receipt of delivery and follow up on the court's actual decision.
Time limits for miscarriage of justice
Chapter 59, Section 2 of the Swedish Code of Judicial Procedure normally states six months from finality for the grounds for miscarriage of justice according to Section 1, first paragraph 1 and 4. For point 2, six months from knowledge of the judgment normally apply; if knowledge came before finality, the time is counted from finality. Point 3 is not covered by the same enumerated six-month time limit in the wording of the legal provision. Always check the legal rules and any special cases in the individual case.
What happens if the court approves the complaint?
If miscarriage of justice is established, the decision can be set aside. According to Chapter 59, Section 3, the court can also decide that the decision may not be enforced in the meantime, and in relevant cases decide on continued handling. The Supreme Court's guidance on miscarriage of justice emphasizes that a very small proportion of complaints are granted. The template package therefore gives no guarantee of approval or stay of enforcement.
Frequently asked questions
What is miscarriage of justice?
Miscarriage of justice is certain serious procedural errors that can lead to a final judgment being set aside. The rules are found in Chapter 59 of the Swedish Code of Judicial Procedure.
Can I complain that the court ruled incorrectly on the merits?
Dissatisfaction with the judgment or another assessment of witnesses and evidence is not sufficient. A concrete ground according to Chapter 59, Section 1 must exist.
How long do I have to complain?
The time limit depends on the ground for miscarriage of justice. For points 1 and 4, six months from finality normally apply. For point 2, a special knowledge period applies. For point 3, Chapter 59, Section 2 does not have a corresponding express six-month rule.
Where do I send the complaint of miscarriage of justice?
Normally to the court of appeal if the decision comes from the district court and to the Supreme Court if it comes from the court of appeal. Special instances may require a different analysis.
Can I stop enforcement with a complaint?
Not automatically. The appellate court can in some cases decide that the decision may not be enforced in the meantime. A separate request must be assessed in the concrete case.
Is this the same as reopening or restoration of time lost?
No. The extraordinary remedies have different grounds, procedural consequences and time limits. Choose the correct order against the background of the decision and the error.
Does Excel produce a ready-made application or decide on miscarriage of justice?
No. Excel is only a case and evidence register. The application is written and reviewed separately in Word; the remedy question is decided by the court.
