About this template

MBL consultation request for operational changes is a document package for Swedish employers who need to prepare and document primary negotiations under Section 11 of the Co-Determination Act (MBL) with the relevant collective agreement-bound employee organisation. You get editable Word templates, searchable PDF versions and an Excel register with nine tabs. Important: the package assumes that Section 11 is applicable. It does not replace the assessment of collective agreements or other negotiation obligations.

When are the templates suitable?

For a planned major organisational operational change, for example a restructuring of functions, when the employer has not yet made the decision to be negotiated. The package is limited to employer-initiated negotiations under Section 11 MBL. It is not a general redundancy or shortage of work template, and does not independently cover Sections 10, 12, 13 or 38 MBL.

01. Package contents

15 customer files in a ZIP: five Swedish work templates, one Swedish user guide and a separate English User Guide, all in Word (DOCX) and corresponding searchable PDF, as well as an Excel workbook (XLSX). Seven documents/guides in two formats, not fourteen different agreement templates.

02. What the files contain

Notice/consultation request, change and decision basis, counterparty and receipt log, negotiation minutes, check of subsequent decisions and actions, as well as Swedish and English instructions. Excel only compiles administrative items and does not decide on legal validity.

Excel: nine tabs and correct status logic

Overview, Cases, Parties, Notices, Basis, Meetings, Decisions, Actions and Read me. Here identified cases, actual dispatches, confirmed receipts, meetings, basis and follow-up are registered. The overview counts registered ID items. The formulas do not decide if negotiation has occurred correctly, when a legal deadline expires or if the employer can decide and implement the change. Empty workbook delivered without test persons.

How the employer uses the package

  1. Test applicability: check collective agreements, negotiation order, correct counterparty and if Section 11 is applicable.
  2. Prepare the subject matter: describe the planned proposal, background, alternatives and consequences without assuming a decision already made.
  3. Send consultation request: state the negotiation question being raised and ensure documentation of actual receipt.
  4. Implement and document minutes: document positions, adjournments, possible adjustment and actual negotiation status.
  5. Check before decision: perform separate legal check before a possible decision and implementation is registered.

Legal conditions and limitations

According to Section 11 MBL, a collective agreement-bound employer shall normally negotiate before making a decision on major operational changes on its own initiative. Section 16 MBL states how negotiation is required. That provision's special two- and three-week rule for certain negotiation meetings is expressly exempted for negotiations under Sections 11–13 and therefore is not used as an automatic time limit in this product. Other rules, collective agreements and situations can affect the procedure. A consultation request is neither a finished decision nor proof of completed negotiation. Read MBL in the Swedish Parliament.

Frequently asked questions

Can the document be used even if the employer lacks a collective agreement?

Not without separate legal check. Then other rules, including Section 13 MBL, may be relevant and this Section 11 package is not an automatic replacement.

Does a two-week negotiation period always apply?

No. The two-/three-week rule in Section 16 second paragraph does not refer to negotiation cases under Sections 11–13. Check concrete legal provision, collective agreements and agreements.

Is a sent email enough for the negotiation obligation to be considered fulfilled?

No. Distinguish between dispatch and documented receipt, and between a consultation request and an actually completed negotiation.

Can the PDF files be filled in directly?

The PDF files are searchable and print-friendly. Editing is done in Word; interactive filling of PDF has not been verified or promised.

Does the package contain English MBL agreement text?

No. English User Guide is a standalone explanatory guide about the Swedish documents and Swedish law.
