What must a member list for an economic association contain?
Chapter 5, Sections 1–3 of the LEF: the board is responsible for the member list and may maintain it using automated processing, in a bound book, or in a secure loose-leaf or card system. The statutory information includes each member's name and postal address, whether the member is an investing member, the time of entry, and the number of member contributions the member holds.
In addition, the list must contain aggregate capital information: the total amount according to the latest approved balance sheet of paid-in or contribution-issued member contributions, as well as certain subsequent payments or the maximum payable amount and the time for these. This aggregated statutory information must not be confused with an individual member's balance or an automatic right to repayment.
Membership: admission, investing members, and resignation
Chapter 4, Sections 1–3 regulate openness, grounds for refusing membership, and the review of a membership application, which is generally carried out by the board unless the bylaws state otherwise. Upon admission as an investing member, this must be expressly stated in the decision in accordance with Chapter 4, Section 6.
Chapter 4, Sections 7–11 contain special provisions on resignation, expulsion, termination of membership, death, and transfers. The resignation date is therefore not automatically the date when the membership actually terminates. Also check which bylaws apply before updating the register.
Availability of the member list and GDPR
In accordance with Chapter 5, Section 5, the member list must be kept available at the association for anyone who wishes to access it. For an electronic list, a current printout or other current representation must be able to be displayed. Chapter 5, Section 7 states that the association is the data controller. Therefore, keep internal case notes, complete payment records, and other non-statutory personal data in separate, access-restricted registers.
In accordance with Chapter 5, Section 6, the member list must be kept as long as the association exists and for at least seven years after its dissolution. Even removed data in automated processing are subject to a special minimum retention period of seven years. Chapter 5, Section 8 gives each member the right to receive written information about their membership and their member contributions free of charge upon request.
Excel tool with nine tabs
The workbook includes Overview, Members, Contribution data, Admission, Resignation, Issuance, Change log, Checks, and Read me. The seven register tabs each have 100 empty rows and relevant status options. The overview counts registered IDs, not legally established membership numbers. Contribution data keeps the aggregated capital information in accordance with Chapter 5, Section 3, Sections 5–7 separate from each individual member.
Excel does not make legal membership admission decisions, automatic contribution repayments, audit reconciliations against the general ledger, expulsion decisions, or a full GDPR review. The association must check and enter actual data.
How the association uses the templates
- Check the association form and bylaws. Review Chapters 4–5 of the LEF and the association's adopted terms.
- Register actual members. Fill in the name, postal address, member type, entry, and number of contributions. Create the board's decision basis in document 02.
- Reconcile aggregate capital. Document information in accordance with Chapter 5, Section 3, Sections 5–7 against the latest approved balance sheet and subsequent payment decisions.
- Process resignations and changes. Use the change log and establish the correct legal termination date.
- Manage access and membership certificates. Provide the access required by law and issue a free written membership certificate upon request.
- Maintain history and protect internal data. The association is responsible for security, updates, access, and archiving.
Frequently Asked Questions
Must an economic association have a member list?
Yes. In accordance with Chapter 5, Section 1 of the LEF, the board must maintain such a list.
Is the member register confidential?
No, not the statutory member list. In accordance with Chapter 5, Section 5, it must be kept available to anyone at the association. This does not mean that all other internal documents or personal data are automatically public.
Must all members' personal identity numbers be in the list?
No, Chapter 5, Section 3 requires, among other things, a name and postal address, not generally a personal identity number. Do not register more personal data than required by a concrete legal basis and a legitimate purpose.
Are the contribution amounts a sum per member or a total amount?
The number of member contributions is registered per member in accordance with Chapter 5, Section 3, Section 4. The Act's information about amounts according to the latest approved balance sheet and subsequent payments in points 5–7 refers to aggregate amounts and payment times.
Does membership end the same day someone resigns?
Not necessarily. The termination of membership is governed by Chapter 4, Sections 9–11, the bylaws, and special cases such as transfers and death.
How long must the member list be kept?
It must be kept during the association's existence and for at least seven years after its dissolution. Special rules apply to older versions and removed electronic data in accordance with Chapter 5, Section 6.
Can Excel automatically determine the repayment of a member contribution?
No, a payment requires an assessment in accordance with Chapter 10 of the LEF, bylaws, balance sheet, and actual decisions. Excel is an administrative register tool.
Has the content been externally reviewed by a lawyer?
The legal text was AI-assisted source-checked on November 2, 2026. No independent external legal review has been documented.
