About this template
Appeal of a District Court Judgment in a Civil Case – Complete Word, PDF, and Excel Package. Prepare a clear appeal to the Court of Appeal by identifying the part of the judgment being appealed, stating the relief sought, analyzing the grounds of the judgment, justifying the request for leave to appeal, and listing the evidence. The template package is tailored to Swedish civil procedure and provides administrative and editorial support for a specific dispute.
Important: An ordinary appeal against a District Court judgment in a civil case must normally be filed with the District Court within three weeks of the date the judgment was issued, pursuant to Chapter 50, Section 1 of the Swedish Code of Judicial Procedure. Always read the appeal instructions in the actual judgment and check any applicable special rules. This package does not automatically calculate the final day and does not replace qualified legal advice. It is not intended for the recovery of third-party costs, appeals in criminal cases, or appeals against administrative decisions.
When should the templates be used?
For individuals or legal representatives in a Swedish dispute involving money or another civil case where the District Court has issued an ordinary judgment and you wish to explore the possibility of having the judgment overturned by the Court of Appeal. The package can be used by businesses and individuals, but complex procedural issues, mandatory protective rules, and special procedures require individual assessment.

How to Write an Appeal – Step by Step
- Check that the judgment is an ordinary judgment in a civil case and that you are using the correct legal remedy. Read the appeal instructions in the judgment.
- Identify the District Court, case number, date of the judgment, opposing party, and the Court of Appeal that will hear the case.
- Check the appeal period and the final day according to the actual judgment and Chapter 50, Section 1. An appeal by joinder pursuant to Chapter 50, Section 2 has its own time and dependency rules.
- State exactly which part of the judgment is being appealed and what change you want the Court of Appeal to order.
- Clearly describe which factual or legal conclusions in the grounds of the judgment are disputed and on what basis.
- State the grounds for leave to appeal pursuant to Chapter 49, Section 14, with a concrete connection to the case.
- List the evidence and the burden of proof. Consider why any new material was not submitted to the District Court.
- Send the appeal to the District Court within the correct time limit and keep the actual proof of receipt.
Legal Rules and Important Differences
Appeal Period and Appeal by Joinder
Chapter 50, Sections 1–3 of the Swedish Code of Judicial Procedure governs ordinary appeals against judgments in civil cases, normally within three weeks of the judgment being issued. Pursuant to Chapter 50, Section 2, an opposing party may, in certain situations, appeal by joinder within a special additional time limit, but such an appeal lapses if the main appeal lapses. Do not use a general automatic date formula.
Formal Requirements Pursuant to Chapter 50, Section 4
The appeal must state the judgment, the part being appealed and the relief sought, the grounds, and why the District Court's grounds of judgment are considered incorrect, circumstances supporting leave to appeal, as well as evidence and the burden of proof. If a piece of evidence or a circumstance has not been previously invoked, the reason must be stated in accordance with the requirements of the provision.
Leave to Appeal to the Court of Appeal
Pursuant to Chapter 49, Sections 12 and 14, leave to appeal is normally required in civil cases unless otherwise provided by applicable exceptions. Leave may be granted if there are grounds to doubt the correctness of the decision, if the correctness cannot be assessed without review, if guidance is needed for the application of the law, or if there are otherwise compelling reasons. Sweden's Courts explain how the Court of Appeal review works.
New Circumstances and New Evidence
In cases where settlement is permitted, there are limitations on invoking new circumstances and evidence in the Court of Appeal pursuant to Chapter 50, Section 25. Always state whether the material is new and investigate the conditions in the individual case. An appeal also does not automatically stay execution.
Frequently Asked Questions
Where Do I Send an Appeal?
To the District Court that issued the judgment, not directly to the Court of Appeal, which is not the normal filing route. Always check the appeal instructions in the judgment.
How Long Is the Appeal Period?
Normally three weeks from the issuance of the District Court judgment pursuant to Chapter 50, Section 1. Exceptions and appeals by joinder may have different rules. The final day must be checked against the original judgment.
Do I Need to Apply for Leave to Appeal?
In civil cases, the Court of Appeal normally must grant leave to appeal. It is not enough to simply state that the judgment is wrong; state concrete circumstances that meet the legal grounds for leave.
Can I Submit New Evidence?
There may be procedural limitations pursuant to Chapter 50, Section 25. Mark which pieces of evidence are new and investigate why they were not previously invoked.
Can I Use the Template for a Third-Party Cost Claim?
Not as a general rule. Third-party cost claims have special rules regarding recovery. Use the correct legal remedy based on the content and instructions of the judgment.
Does Excel Calculate the Appeal Period or Chance of Success?
No. Excel only contains actual registered dates, documents, checks, and simple administrative amounts. No legal assessment is automated.
