About this template

Request for correction and amendment of an administrative decision – a practical document package in accordance with Swedish administrative law. Helps individuals, businesses and representatives distinguish between an obvious clerical or calculation error and a request to amend an incorrect decision. Includes Swedish Word templates, corresponding searchable PDF files and an Excel-based case register.

Important limitation: Correction and amendment are different legal procedures. A request for correction or amendment does not automatically stop an appeal deadline and does not guarantee that the decision will be changed. Check the special legislation, decision-making authority, third-party interests and whether an appeal has already been submitted.

01. Package contents

7 editable Word (DOCX), 7 corresponding searchable PDF and 1 Excel (XLSX) – 15 customer files in total. Five Swedish working documents, a Swedish user guide and an English user guide, plus an Excel workbook with nine tabs. Digital ZIP delivery via Shopify Digital Products after manual file linking and publication.

02. What the files contain

Separate request under Section 36, request for amendment under Section 37, grounds for review under Section 38, check of appeal status under Section 39, decision and communication log, two guides and an Excel register. The workbook organizes cases, submissions, enclosures, appeals, decisions and actually implemented measures. It does not make any legal assessments.

When is the document package suitable?

For anyone who has a concrete decision from a Swedish administrative authority and needs to prepare a request for correction of an obvious oversight or amendment of a first-instance decision when the Administrative Procedure Act is applicable. It is not a substitute for a formal appeal or special review provisions, for example in the field of tax or social insurance.

The difference between correction and amendment

Section 36 of the Administrative Procedure Act: the authority may correct obvious errors caused by clerical errors, calculation errors or similar oversights. Section 37: the authority may, under certain conditions, amend an incorrect decision it has issued at first instance. Decisions favourable to an individual are particularly protected against amendment to their detriment. Section 38: amendment is mandatory only when all statutory conditions are met. Section 39: when the decision has already been appealed, the decision-making authority's ability to amend is limited.

The Excel tool

Contains nine tabs: Overview, Cases, Correction, Amendment, Enclosures, Appeal, Decision, Measures and Read Me. Eight administrative key figures calculate registered data and manually marked statuses. No macros are required. The workbook distinguishes between requested and decided, as well as between planned and implemented measures. It does not calculate appeal deadlines, assess whether a requirement is met or send documents.

Practical workflow

  1. Identify the decision-making authority, decision ID, party and applicable law.
  2. Determine whether it is an obvious clerical/calculation error or a substantive issue; select only the relevant document.
  3. Describe concretely which information is incorrect, the proposed correction and the supporting facts.
  4. Check whether the decision has been appealed and whether the appeal deadline is still running.
  5. Send to the correct authority and retain supporting evidence showing actual receipt.
  6. Record the actual decision and any subsequent measures separately in Excel.

Legal requirements and exceptions

The Administrative Procedure Act (2017:900), Sections 36–39 regulates correction and amendment. According to Section 38, the obligation to amend requires, among other things, an obvious error in a material respect and a quick and simple amendment without detriment to any individual party. If the decision has already been appealed, the limitations in Section 39 apply, including that the documents have not yet been submitted to the appellate authority. Sections 2–4 of the Administrative Procedure Act and special legislation may limit applicability. Appeals, enforcement and deadlines must be assessed separately.

Frequently asked questions

Can I request correction if I think the decision is wrong?

Yes, you can request the authority to review it, but an obvious clerical or calculation error under Section 36 is not the same as a dispute over the substantive content of the decision. Select the correct document and check other applicable procedures.

Must the authority amend an incorrect decision?

Not always. According to Section 38, all special conditions must be met. In other cases, the authority may have an opportunity to amend under Section 37, but even that has limitations.

Does the request stop the time for appeal?

No, not automatically. Check the decision notice, any special rules, the competent authority and the appeal deadline separately.

Can I use the templates if the decision has already been appealed?

This requires special checking. Section 39 limits when the decision-making authority may amend an appealed decision. Check whether the case documents have already been submitted to the appellate authority.

Are the PDF files digitally fillable?

The PDF files are searchable print versions, not interactive forms. Edit the DOCX files for individual completion.

What does English User Guide mean?

English explanatory text to help understand the Swedish documents; the documents and legal system are Swedish.
