About this template

Temporary access to neighboring property – consent, work and restoration

Do you need to use a neighbor's land for a limited period for facade maintenance, inspection, scaffolding or similar work? This agreement package for voluntary access to neighboring property helps property owners, contractors and clients document who gives permission, exactly which area is affected, the time period, precautionary measures and how the land should be restored.

The package is intended for temporary permission from the authorized landowner. It does not create an easement, permanent right of use, right to lay pipes or government permission. If the land rights are unclear, the work should not be treated as permitted solely by filling out this template.

Why use a separate access agreement?

When someone needs to enter a neighbor's land, an oral discussion with the site manager is not always enough. A clear document can delimit the actual consent: which property is affected, where scaffolding or materials can be placed, on which dates and who is responsible for protection measures. Photographs before and after the work make it easier to document actual changes.

Excel tool – nine relevant tabs

Excel contains Overview, Parties, Areas, Notices, Risks, Daily Log, Damages, Restoration and Read me. Formulas summarize administrative data and calculate risk scores from entered probability and consequence. The register distinguishes between planned, performed and verified measures. An entered value is not a signed consent, proven damage or established compensation liability.

Practical user guide – step by step

  1. Check the landowner's identity, authority and whether other co-owners or rights holders need to participate.
  2. Mark the exact access area on a dated map and define work, times and machines in the main agreement.
  3. Obtain express permission and handle advance notice separately. A lack of response should not be equated with approval.
  4. Check any land permits, other authority requirements, insurance and work environment measures for the work in question.
  5. Photo-document the condition before work, follow up on risks and deviations and make a joint documented final inspection.

Legal prerequisites and formal requirements

The Land Code, Chapter 3, Section 1 prescribes reasonable consideration when using immovable property. Chapter 3, Sections 3–4 contain special rules on excavation and protection measures; these do not imply any general right to use a neighbor's land for example for scaffolding work. A voluntary agreement must be entered into by the right persons and have a sufficiently specified scope. This product is intended for temporary agreement-based access and does not replace any special review of statutory exceptions.

The Tort Liability Act, Chapter 2, Section 1 deals with compensation for personal or property damage caused intentionally or through negligence. Documented damages, agreed compensations and disputed claims must be kept separate. The annex's damage log does not determine liability. Land permits may be required for certain excavations, fills and other land measures; Boverket's guidance shows that the requirements depend on the location and detailed plan.

Individual advice: seek expert assessment in cases of co-ownership, unclear property status, land lease or leasehold, larger excavation work, unclear utility rights, disputes, extensive damage risks or questions regarding work environment and authority requirements. The files are not an authority form or a guarantee of access rights and no external legal review has been carried out.

Frequently asked questions

Does the access agreement give me the right to always walk across the neighbor's land?

No. The permission is delimited to the parties, location, time and agreed work. It does not create a permanent property right.

Is it enough that the neighbor has received an email about the work?

No. Received information is not the same as authorized permission. If access is based on a voluntary agreement, consent must be documented.

Does a general statutory right apply to place scaffolding at the neighbor's property?

No. The Land Code contains special rules on protection measures in connection with excavation, but not a general right to place scaffolding on a neighboring property.

Do I need a land permit even if the landowner consents?

It depends on the actual measure and the location's regulations. The landowner's permission does not replace a permit or other authority review.

Are the PDF files fillable and are the templates bilingual?

The PDFs are searchable and printable. The Word files are editable. The five working templates are in Swedish; a separate English-language guide is included.

For permanent property rights, there are easement agreements and for road/exit issues easement agreements for road and exit. For actual condition descriptions, inventory list and inspection protocol may also be relevant. See Mallbutikens FAQ for general questions about digital templates.
