About this template
Tree branches and roots at the property boundary – neighbor agreement, notification and pruning protocol
Branches or roots from a neighbor's tree can cause practical problems. With this document package you can conduct a constructive dialogue, identify encroaching branches or roots, document the property boundary, check protection issues and draw up a clearly defined agreement on an approved action. The package is suitable for private property owners, housing managers and others who want to keep notifications, photos and follow-up organized.
The documents are based on Swedish property law, specifically Chapter 3, Section 2 of the Land Code. Under specified conditions, this provision may apply to encroaching roots or branches that cause inconvenience, but it gives no general right to fell a neighbor's tree. If there is a risk of significant damage, the tree owner must be given the opportunity to carry out the action themselves. Therefore, the package includes specific checkpoints for scope, contact, natural values and competence.

Step by step – how to use the templates
- Identify the affected properties and owners. Enter the property designation, check for any leasehold rights and obtain boundary documentation. The Swedish Land Registry's digital overview maps are not legally decisive in cases of unclear boundaries.
- Describe the inconvenience concretely. Use the tree status and photo appendix to distinguish encroaching roots or branches from a desire to fell the tree for aesthetic reasons. State the location, date and photo ID.
- Contact the neighbor constructively. The notification template includes space to describe the proposal and document the tree owner's opportunity to carry out the action themselves when required. A lack of response does not automatically constitute full consent.
- Perform necessary protection and authority checks. The detailed plan's possible land use permit, natural values, bird nests and arborist competence must be assessed for the specific tree.
- Define the scope of the agreement. Only write in the action that can legally be carried out and that the parties are authorized to agree to. A separate access permit may be required if anyone is to enter the other's property.
- Follow up on actual work and costs. Use the final inspection protocol and Excel register without the registration automatically counting as proven damage, admitted liability or authority approval.
Excel register with nine real tabs
Overview provides a formula-driven summary. Parties collects controlled contact details; Tree Register identifies the trees; Inconveniences describes the encroachment; Notifications tracks communication; Pruning Plan contains the plan and action status; Risks calculates probability × consequence when both values are filled in; Costs calculates hours × hourly rate plus other specified costs; Read Me explains the fields and the division of responsibility.
The formulas are administrative aids. They do not assess the tree's stability, the legal status of the property boundary, an agreed liability issue or whether an authority review is required. The workbook is free of actual personal data and fictitious test cases.
Important legal matters – rights and limitations
Chapter 3, Sections 1–2 of the Land Code: each person shall show reasonable consideration when using immovable property. If a root or branch encroaches from an adjacent area and causes inconvenience, the property owner may, according to Chapter 3, Section 2, remove it under specified conditions. If the action is expected to cause significant damage to the tree owner, they must be given the opportunity to carry out the action themselves. Special rules for leasehold rights must also be observed.
The boundary must be clarified. A map in a digital map service is for orientation, not always a fixed legal boundary. In cases of unclear property boundaries, relevant documents must be reviewed and sometimes a Land Registry case may be required.
Land use permit and nature conservation: a land use permit may be required under certain conditions for felling trees within a detailed plan area, for example where the municipality has decided on protection provisions. Substantial actions on particularly valuable trees that can significantly change the natural environment may require consultation according to Chapter 12, Section 6 of the Environmental Code. Protection for birds, nests and other species can also affect the possibility of pruning.
Work and damage risk: tree felling, cutting at great heights, root damage to load-bearing structures, especially old trees or suspicion of instability require competent assessment, often an arborist. The templates do not contain chainsaw, climbing or arborist instructions. The cost journal does not determine whether liability for damages exists.
When should you seek help? In case of dispute over boundaries, co-ownership, valuable trees, land use permits, species protection, extensive damage risk, professional pruning or unclear liability, individual legal or technical advice and contact with the municipality/county administrative board may be needed.
Note before 2027: changes in the Species Protection Ordinance (2007:845) come into force on 1 November 2026. The checks in the templates are deliberately formulated as current protection and permit assessments, not as an exhaustive list of the law's wording. Check the current provisions when actually carrying out the work.
Frequently asked questions
Can I saw off all branches from the neighbor's tree that hang over the property?
Not without question. The Land Code refers to encroaching branches or roots that cause inconvenience and includes a special requirement to give the tree owner the opportunity to carry out the action themselves when significant damage can occur. Also assess the boundary, natural values, permits and safety.
Can I fell the entire neighbor's tree with support from Chapter 3, Section 2?
No, the provision does not give any general right to fell a tree that stands on another property. Other powers and permits must be assessed separately.
Is a sent letter the same as the neighbor having approved the work?
No. The notification documents contacts and the possible opportunity for the tree owner to carry out the action themselves. If voluntary consent is needed, its scope, competence and existence must be verifiable.
Do I need a land use permit for pruning or tree felling?
It depends on the actual action and the plan/protection provisions for the area. Check the municipality's information and any nature conservation requirements before the work.
Are the PDF files editable and are the agreements in English?
The DOCX files are editable. The PDF files are searchable and printable; interactive PDF forms are not promised. The five working documents are in Swedish; a separate English-language guide is included.
