When should a building lease be terminated?

According to the general rule in Chapter 11, Section 3 of the Land Code, the building lease must be terminated no later than six months before the end of the lease term, unless another time has been agreed. If termination is not made in time, an agreement is extended according to the general rule for the same period as the previous lease term, but no more than five years, unless otherwise agreed. A building lease presupposes, among other things, land for acquisition activities with a building of more than minor importance. Always classify the agreement before using the forms.

Important when the landowner terminates

Chapter 11, Section 6 of the Land Code sets special requirements. The landowner's termination must state either the reasons for refusing extension or the terms offered for extension. It must also inform the lessee that a dispute must be referred to the Landlord-Tenant Tribunal for mediation within two months of the termination if the lessee does not accept vacating without compensation. Without this information, the termination may be ineffective.

Indirect security of tenure – compensation instead of automatic extension

In some cases, a building lease provides indirect security of tenure. This means that the lessee may need to vacate but may have a right to compensation under certain conditions according to Chapter 11, Section 5. It is not the same as the right of extension that may exist in agricultural or residential leases. The conditions for compensation depend on the agreement, the reasons for termination, and whether applicable procedural rules have been followed. A dispute over compensation can ultimately be heard in the district court.

Lessee requesting a change of terms

If the lessee terminates the agreement for extension on changed terms, Chapter 11, Section 6 a applies. The lessee must then refer the dispute to the Landlord-Tenant Tribunal themselves within two months of the termination. Otherwise, the termination is ineffective. The letter template does not replace the mediation application.

Service and evidence log

Termination must be made in the correct form and normally served according to Chapter 8, Section 8 of the Land Code. The special supplementary rule in Chapter 8, Section 8 a regarding registered mail to a regular address expressly applies to agricultural and residential leases, not building leases. An Excel note or a submission receipt does not alone show that service is legally completed. Use the protocol for actual traceability – not as an automatic validity guarantee.

Excel register and administrative control points

The register collects manual agreement data, notifications, mediation, dispatch events, open actions, and handover. The Overview tab summarizes the number of registered cases and manual statuses. There are no macros, automatic legal dates, authority links, or automatically established service. Excel is a working tool; do not use it as the sole documentation of legally significant events.

How to use the package

  1. Check the lease form, the building's importance, and the current written agreement.
  2. Establish the agreed or applicable notice period and the correct agreement end date.
  3. Choose between landowner/lessee and vacation/change of terms.
  4. Complete all factual information and retain mandatory statutory mediation notices.
  5. Arrange lawful service, save verifications, and follow the separate mediation deadline.
  6. Inventory buildings, installations, and any compensation or restoration issues at handover.

Frequently Asked Questions

Does a six-month notice period always apply?

No. Six months is the starting point of the law in Chapter 11, Section 3 when the parties have not agreed on another time. Read the agreement first.

Can the landowner terminate without stating reasons?

A landowner's termination must contain the information required by Chapter 11, Section 6 – either the reason for refusing extension or the terms for extension, as well as the mediation deadline notice.

Does the lessee have the right to stay?

Indirect security of tenure normally does not provide an automatic right to continued lease. Compensation rules may instead become applicable.

Are the PDF files interactive forms?

No. The PDF files are searchable and printable. Edit in the DOCX files using compatible software.

Do the templates apply to agricultural and residential leases?

No. The other lease forms have their own rules and require separate documents.
