About this template

Boat haul-out and winter storage – contract templates, intake protocols, and Excel

Is a leisure boat to be stored on land during the winter? This document package helps boat owners, marinas, shipyards, and storage providers clearly document agreed services, the boat's actual condition upon delivery, the location, storage period, insurance details, additional work orders, and return at the end of the season.

The package is intended for boat haul-out and winter storage on land. It expressly distinguishes between an undertaking to take care of and store a consumer's boat and merely providing a storage area. Which contract model and legislation applies depends on the actual service. No standard text that generally exempts the storage provider from all liability is included.

Nine tabs: Overview, Boats, Intake, Storage Locations, Services, Checks, Deviations, Return, and Read Me XLSX

This is why intake and return are important

An agreed winter storage period is not always the same as the boat actually having been received. The intake protocol has fields for date, location, boat ID, identified damages, keys, and the persons who participated. A corresponding documentation is made at return. The photo register helps to find original photos, but does not in itself determine whether damage occurred during storage or who is responsible.

The Excel register – nine tabs with practical calculations

The workbook has the tabs Overview, Boats, Intake, Storage Locations, Services, Checks, Deviations, Return, and Read Me. It handles, among other things, boat ID, insurance check, actual intake, location, work order, status, events, and return. Services calculates approval-independent administrative labor costs using the formula worked hours × price per hour + entered material, transport, and other costs. Overview summarizes register entries and open deviations using formulas.

The formulas are not an automatic invoice, VAT assessment, damage assessment, or certification that work was actually performed. Insurance, risk classification, damages, and legal liability are checked separately by authorized persons.

How to use the document package

  1. Choose the right service. State whether the agreement concerns storage as a service or merely the provision of storage space, and describe what the storage provider is actually supposed to do.
  2. Identify the boat. Check the hull or registration number, engine, accessories, and contact details. Review the actual scope of the insurance for winter haul-out, transport, fire, and theft.
  3. Document the handover. Photograph the observed condition and any existing damages. Save original photos with the date and note the received keys.
  4. Define technical responsibility. Hire a competent provider for haul-out, lifting, support, gas, electricity, fire, and engine preservation. A checkbox in the form does not mean that the check has been performed.
  5. Order additions separately. Haul-out, washing, preservation, covering, and launch should only be included if they have been expressly ordered and priced.
  6. Follow up and return. Note incidents in Excel, perform a joint final check, and document when the boat is actually picked up. A signed protocol does not mean that a consumer automatically waives statutory rights.

Legal background – what the agreement may not conceal

Consumer Services Act (1985:716): According to Section 1, the Act applies, among other things, when a business operator performs storage of loose items for consumers. According to Section 3, terms that are worse for the consumer than the provisions of the Act are normally without effect. Sections 4, 15, 17, and 31–32 contain, among other things, provisions on professional competence, storage defects, complaints, and damages. Cancellation rules are covered in Section 42. The parties should not use the template to circumvent such mandatory rules.

Pure provision of space: If the business only rents out land/storage space without taking care of the boat, the type of agreement must be assessed based on the actual circumstances. Calling an actual storage service “provision of space” does not automatically change the legal content. The template therefore includes a separate choice of model and a clear account of work tasks, actual care, and possession.

Insurance: Check with the insurance company which risks are covered on land, for example transport, theft, fire, storm, and damages during haul-out. Insurance details do not provide a general liability waiver. Environment: Boat bottom paint can result in contaminated wash water and waste. Flushing, scraping, sanding, and remediation need to be handled at a suitable facility according to the rules and environmental procedures applicable to the business.

Limitations: The documents do not replace professional lifting, support, engine safety, gas or electricity checks, fire safety inspection, or an individual legal dispute assessment. For extensive storage or high-risk services, external legal and technical expertise is recommended.

Frequently asked questions

Does the Consumer Services Act apply when a company stores my boat for the winter?

Yes, normally when a company undertakes the storage of a consumer's boat. If only pure storage space is provided, the actual service must be assessed. The Consumer Services Act has mandatory protections in relevant parts.

Can the storage provider state that the boat owner always bears all risk?

A general waiver cannot override mandatory consumer protections. Liability depends on the law, actual circumstances, and valid contract terms. Insurance coverage should be checked separately.

Are boat haul-out, winter preservation, and launch included automatically?

No. Document 04 is used for separate ordering, pricing, and approval of any additional work.

Does the intake protocol provide proof that the boat was completely defect-free?

No. The protocol documents the observations that were actually made. It does not automatically provide a complete inspection or a final determination in a dispute.

Are the Word and PDF files editable?

The Word versions are editable. The PDF versions are searchable and can be printed. An Excel workbook with nine tabs is included for registration and cost tracking.

Are the work documents in English?

The five work templates are in Swedish. A separate English user guide is included for those who need to understand the workflow in English.
