About this template
Building Sanction Fee – Statement Before Decision, Rectification and Evidence Register
Have you received a letter from the building committee about a possible building sanction fee? This document package helps you prepare a substantive statement, structure a chronology of events, document any rectification, review the committee's calculation, and keep track of evidence, submitted documents, and actual authority decisions.
Important: This is a private document and work tool, not the building committee's form, a completed legal objection tailored to your case, or a promise that the fee will be removed. The product's main document is a statement before decision and should not be confused with an appeal against a fee that has already been decided.
01. Package Contents
15 customer files: 7 editable Word documents (DOCX), 7 corresponding searchable PDF files, and 1 Excel workbook (XLSX) with nine functional tabs. Five work templates, a Swedish guide, and an English reading guide are available in both Word and PDF. Delivered as a ZIP file.
02. What the Files Contain
Statement to the municipality, traceable event and evidence matrix, rectification notice, objection to calculation basis, communication and decision log, two guides, and an Excel register for documented violations, rectifications, evidence, and actual fee decisions. The workbook does not calculate legal deadlines or statutory sanction amounts.

How to Use the Templates for a Possible Building Sanction Fee
- Read the municipality's communication letter: check the diary number, property, alleged violation, proposed amount, legal provisions, and last day to respond.
- Gather the facts: document dates, permits, application, commencement notice, construction contract, photographs, and other evidence. Mark uncertain information as uncertain.
- Check if rectification has actually occurred: document what was restored, when, and how. A new building permit application is not always the same as rectification.
- Check responsibility and amount: compare the committee's calculation breakdown with the PBL and the Planning and Building Ordinance, and check whether exceptions or reductions are applicable.
- Respond in writing: submit the statement and enclosures within the committee's specified response time. Save a copy and proof of receipt.
- Follow up on the decision separately: if a fee is decided, the actual appeal instructions and payment terms must be checked.
Right to Make a Statement According to Chapter 11, Section 58 of the PBL
According to Chapter 11, Section 58 of the Planning and Building Act (2010:900), the person against whom a claim for a building sanction fee is directed must be given the opportunity to make a statement before the supervisory authority makes a fee decision. A fee may not be decided if the affected person has not had the opportunity to make a statement within five years after the violation. However, the actual nature and timing of the violation must be carefully assessed; a claim of prescription cannot be based solely on how long something has been on the premises. The Boverket explains communication and the five-year rule.
Can Rectification Prevent the Building Sanction Fee?
According to Chapter 11, Section 54 of the PBL, a building sanction fee shall not be charged if rectification occurs before the issue of sanction or intervention has been raised for consideration at a meeting with the supervisory authority. It must be an actual and relevant rectification, supported by documentation. The package helps you document when and how rectification occurred, but does not determine whether the requirements of the law are met. See Boverket's overview of when a fee should be charged.
Who Can Be Liable to Pay?
According to Chapter 11, Section 57 of the PBL, the fee may be directed against the person who owned the property or building when the violation occurred, the person who committed the violation, or the person who received a benefit from it. The fee can generally be charged even if no one acted intentionally or negligently, but Chapter 11, Section 53 contains special grounds for exemption.
Exemptions and Reductions
Chapter 11, Section 53 of the PBL regulates, among other things, unreasonableness due to special circumstances beyond the fee-payer's control. According to Chapter 11, Section 53 a, the fee may in individual cases be reduced to half or one-quarter if it is not in reasonable proportion to the violation. This is an individual assessment, not a general discount. The fee calculation is primarily governed by Chapter 9 of the Planning and Building Ordinance (2011:338) and must be checked against the current violation category. Boverket's guidance on building sanction fees.
The Difference Between a Statement and an Appeal
Statement before decision: submitted to the building committee while the case is still being processed, and should give the affected person the opportunity to respond to allegations and the calculation basis.
Appeal after decision: if the committee has decided on a building sanction fee, the decision can normally be appealed to the County Administrative Board, but the appeal must be submitted to the municipality according to the instructions in the decision, normally within three weeks of service. The payment rule is different: according to Chapter 11, Section 61 of the PBL, a fee must generally be paid within two months of service, unless a later date has been specified. Always follow the concrete decision. The County Administrative Board's guidance.
Excel Register – Nine Tabs
Dashboard, Cases, Violations, Rectification, Fees, Evidence, Communication, Deadlines and Decisions, Read Me. Eight formula-driven key figures show administrative counts and totals: registered cases, submitted statements, open violation investigations, verified rectifications, received evidence, fee objections, manually registered decided fees, and open deadline monitoring. Excel does not perform automatic legal interpretation, prescription assessment, sanction calculation, or deadline calculation.
Frequently Asked Questions
Can I Make a Statement Before the Municipality Decides on a Building Sanction Fee?
Yes. The person at risk of the fee must be given the opportunity to make a statement according to Chapter 11, Section 58 of the PBL. Respond within the municipality's actual response time.
Does the Fee Automatically Disappear if I Rectify the Error?
Not automatically. Rectification before the correct time according to Chapter 11, Section 54 may prevent a fee, but what counts as rectification and when the consideration occurred must be checked.
Can the Fee Be Reduced?
Yes, in certain individual cases, a fee may be reduced to half or one-quarter according to Chapter 11, Section 53 a of the PBL. Substantive reasons are required.
Must the Municipality Show Who Is Liable to Pay?
According to Chapter 11, Section 57, there are different categories of persons liable to pay. The owner, contractor, and the person who received a benefit may be liable depending on the actual circumstances.
Can I Use the Document Package to Appeal a Decision Already Made?
It is primarily designed for a statement before decision. The decision log helps with follow-up, but an appeal requires a separate letter and a review of the instructions in the decision.
Does Excel Calculate My Building Sanction Fee?
No. You can register the municipality's amount and actual decisions, but the statutory fee and exemptions are not calculated automatically.
Are the Pieces of Evidence That Need to Be Attached Included?
No. The package contains matrices and registers. You must provide actual photographs, decisions, invoices, and relevant documents yourself.
Are the PDF Files Editable?
The PDF versions are searchable and printable. Edit the content in the Word versions.
