Written agreement and lease type
Agricultural leases require a written agreement. The actual use determines the lease type. A farm lease with housing for the tenant normally has a minimum five-year term unless the tenancy tribunal approves a shorter term. A side lease without housing has no equivalent minimum.
Term and termination
For terms of at least one year, termination is generally needed to end the lease at expiry. Notice is normally one year for terms of five years or more, otherwise eight months. Shorter agreements and protected leases have special rules. Check deadlines for referring a dispute to the tenancy tribunal.
Security of tenure
Security of tenure may allow review of renewal, but does not guarantee an unconditional right to stay. Side leases of no more than one year without housing normally fall outside statutory security of tenure. Waiver can require tribunal approval.
Agricultural support
Swedish payment entitlements (stödrätter) were abolished in 2023. Adapt old clauses about transferring entitlements; document current support applications and commitments instead. The lease itself does not confer entitlement to support.
Using the template
Identify the parties and exact area, attach a clear map where necessary, set rent and a lawful term, allocate responsibilities, check notice and renewal rules, then sign and retain the agreement. Check transfer, subletting, property-sale effects and maintenance under applicable rules. A template does not guarantee legal compliance in every situation; obtain specialist advice where needed.
