Private sale or consumer sale?
The agreement begins by having the parties identify which type of purchase applies. This is crucial for determining which rules apply.
Private individual to private individual: The Sales of Goods Act is generally applicable as supplementary legislation. The Sales of Goods Act is dispositive, meaning the parties' agreement carries significant weight.
Business to consumer: The Consumer Sales Act applies. It is primarily mandatory for the consumer's benefit, and standard terms may not provide the consumer with fewer rights than the law.
The horse's identity is carefully documented
The purchase agreement contains clear fields for:

Horse passport and central horse database
All horses must have a horse passport. The horse passport must accompany the horse but is not proof of ownership. If ownership details need to be updated in the passport issuer's register, the relevant organization needs to be contacted.
Horses that are to be kept at a facility for at least 30 days must normally be registered at that facility. For this, the horse needs to be in the central horse database, and the UELN number is a key identification detail.
Defects and claims in private sales
In private sales, the primary governing factor is what the parties have agreed upon. The Sales of Goods Act supplements the agreement where regulations are missing. A general statement that the horse is sold in "as is" condition does not automatically exempt the seller from liability, for example, if incorrect information has been provided or significant known conditions have been withheld.
Special rules for consumer purchases of live animals
The Consumer Sales Act contains special provisions for live animals. Defects that appear within six months after delivery are covered by a special presumption rule.
If the price of the animal exceeds one-tenth of the price base amount, the trader and consumer may, under the conditions of the law, agree to exceptions from this specific presumption rule.
The price base amount is SEK 59,200 for 2026 and SEK 59,600 for 2027. The threshold therefore becomes SEK 5,920 and SEK 5,960 respectively. For a standard horse purchase, the amount requirement will normally be met.
