About this template

Car complaint 2026/2027 – template for defects in cars from dealerships or private sellers

Have you discovered a defect in a used or new car and need to write to the seller? This package contains two different complaint letters in Word: one for a car purchased from a dealership and one for a car purchased from a private individual. The templates are supplemented with a defect description, evidence list, follow-up letter, expense log, and an Excel register that helps you document contacts, dates, and actual out-of-pocket expenses.

The legal rules differ significantly. Choose the letter that corresponds to who actually sold the car; do not use the Consumer Sales Act's three-year rule for private purchases. The product is an editable work template, not individual legal advice or a guarantee that the complaint is justified.

Digital package: 7 Word (DOCX), 7 corresponding searchable PDF (A4), 1 Excel (XLSX). Five Swedish main templates, a Swedish user guide, and a separate English User Guide. No subscription or physical shipping.

Important difference between dealership and private purchase: When a consumer buys a car from a business, the Consumer Sales Act (2022:260) normally applies with three years of liability for defects from the time of delivery, provided the conditions of the law are met. If the buyer purchases from a private individual, the agreement applies first, followed by the Sale of Goods Act (1990:931), with normally two years from receipt. Both require a complaint within a reasonable time after discovery or what the buyer should have noticed. Cancellation, price reduction, or damages do not occur automatically.

Each Word and PDF document has two framed information boxes with the headings “01. Package contents” and “02. What the files contain”, as well as a clear legal delimitation. The Word files contain highlighted fields for car details, buyer, counterparty, dates, and documents that must be filled in with correct information.

03. The Excel tool for car complaints

Nine tabs: Overview · Cars & purchases · Defect register · Complaints · Contacts · Repairs · Costs · Evidence · Read me.

The Excel overview shows 16 key figures, such as the number of registered car purchases, defects, sent complaints, contacts, workshop cases, and documented amounts. Amounts that the customer has actually paid are kept separate from what has been requested, what the counterparty has admitted in writing, and what has actually been received. A formula calculates the remaining part of the admitted amount – not a legally established debt.

Important: Excel does not calculate a universal complaint deadline and does not determine if a defect is original or if you are entitled to cancellation. The register sheets do not contain fictional vehicles, defects, or payments. Status markings must be verified manually.

How to complain about a defect in a car – ten steps

  1. Check the seller. Use the purchase contract to distinguish between a car dealership and a private seller; a brokered deal may require special analysis.
  2. Collect the purchase documents. Save contract, advertisements, description, product declaration, warranty, inspection, and delivery date.
  3. Describe the car's defect. State concrete symptoms, date of discovery, odometer reading, and any error codes or workshop observations.
  4. Assess the time limits. Consumer purchases: three years of liability for defects as a main rule, and a complaint within two months of discovery should always be considered timely. Private purchases: the agreement and the Sale of Goods Act's two-year rule with a complaint within a reasonable time.
  5. Choose the right letter. Use document 01 for relevant consumer purchases or document 02 for private purchases.
  6. Write to the seller. Save sent email, postal receipt, or other traceable documentation.
  7. Provide an opportunity for assessment and rectification. Do not simply order an alternative repair before you have assessed the seller's opportunity to examine the defect.
  8. Document all contacts. Use the evidence attachment and Excel for timeline, contacts, repairs, and actual receipts.
  9. Follow up in writing. Use document 04 if the counterparty does not return and specify a reasonable desired response date.
  10. Assess continued proceedings. ARN (the National Board for Consumer Disputes) may be relevant in consumer disputes against traders under the board's conditions, but normally not in disputes between private individuals.

What law applies to car complaints?

Car purchased from a dealership – Consumer Sales Act

A consumer who buys from a car dealership is generally covered by the Consumer Sales Act (2022:260). Chapters 4 and 5 of the Act regulate defects, liability, and remedies. The Swedish Consumer Agency explains that the defect must normally have manifested during the three-year liability period and that the buyer needs to file a complaint within a reasonable time. For complaints within two months of discovery, the complaint is always considered timely. If the defect manifests during the first two years, there is a statutory presumption of an original defect, with conditions and exceptions. This is not the same as a guarantee that every breakdown will be compensated.

The buyer can normally request rectification or redelivery according to the conditions of the law, while price reduction and cancellation require specific conditions. According to the Swedish Consumer Agency's guidance on car complaints, it is important to contact the seller, substantiate the defect, and normally give the car dealership an opportunity to rectify it.

Car purchased from a private individual – Sale of Goods Act

When both the buyer and seller are private individuals, the parties' agreement applies first, followed by the Sale of Goods Act (1990:931). Section 32 of the Sale of Goods Act requires a complaint within a reasonable time, as a main rule no later than two years after the car was received. The assessment of the defect is influenced by factors such as the car's age, price, condition, the seller's information, and the agreement. A clause about "as-is condition" does not necessarily exclude all liability. Also, read the Swedish Consumer Agency's guidance on defects in cars purchased from private individuals.

Defect description, evidence, workshop, and costs

A complaint should describe what the buyer considers to be a defect and when it was discovered. Photos, advertisement information, agreements, workshop diagnoses, and service documents can help. However, a diagnosis does not always show that the defect existed at the time of delivery. Any claims for compensation should correspond to actual, substantiated, and legally relevant costs; the car dealership may need to be given the chance to rectify before an outside workshop is hired.

Frequently asked questions about car complaint letters

How long can you complain about a car bought from a car dealership?

According to the Consumer Sales Act, there is normally a three-year liability for defects from delivery. A complaint must be made within a reasonable time after the defect is noticed; within two months is always considered timely. Special circumstances may affect the assessment.

How long can you complain about a car bought privately?

As a main rule, the Sale of Goods Act's two-year limit from receipt applies, together with the obligation to complain within a reasonable time. The agreement and certain exceptions can change the assessment.

Must the car dealership buy back the car?

No. A defect does not automatically give the right to cancel the purchase. The seller often has the opportunity to rectify, and further legal requirements must be met for price reduction or cancellation.

Does the right to complain also apply to a used car?

Yes, the Consumer Sales Act also covers used cars when purchased from a trader. What constitutes a defect is assessed with regard to factors such as condition, price, age, mileage, and information provided at the time of purchase.

Can I file a complaint without a workshop report?

A clear, written description of the defect may be enough to file a complaint in time. Depending on the objections, additional documentation or independent troubleshooting may be needed to substantiate liability.

Are documents for private purchases included?

Yes. A separate Swedish Word and PDF letter is adapted to assess defects based on the purchase agreement and the Sale of Goods Act – not the Consumer Sales Act's conditions for car dealerships.

Can Excel determine the last complaint date?

No. Excel records dates and supporting documents but does not provide automatic legal decisions about deadlines, defect liability, cancellation, or compensation.

Are English car complaint letters included?

No. Five main templates are Swedish. An English User Guide is available for those who need to understand how the documents are used.

Is the template legally certified?

No. The documents are editorially reviewed against cited authority and legal sources, but no external lawyer or authority certification is claimed. Adjust according to the individual transaction.
