About this template

Prenuptial Agreement for Specified Separate Property – Swedish Law

This English-language template is intended for spouses or future spouses who want to make specific identified property separate property under Swedish law while leaving other property outside that specific designation.

The template can be adapted for a specified home, real property, shares in a company or another clearly identifiable asset. It is not intended for time-limited or conditional arrangements such as making property separate only for a certain number of years or only in the event of divorce.

What the template is designed to document

  • Identification of both parties.
  • The specific property that is to be separate property.
  • Whether income or returns from the specified property should also be separate property.
  • That property outside the stated scope is not covered by this designation.
  • Date and signatures.

Important under Swedish law

A Swedish prenuptial agreement (äktenskapsförord) must be in writing, dated and signed by both spouses or future spouses and registered with the Swedish Tax Agency (Skatteverket) to take effect as a prenuptial agreement. Swedish law does not require witnesses.

Current guidance from the Swedish Tax Agency states that a prenuptial agreement cannot be made subject to a time limit or condition. If the spouses later want to change the classification of the property, they should execute and register a new prenuptial agreement.

Note: This product has temporarily been set to draft while Mallbutiken verifies that the downloadable file fully matches the updated 2026 description and current Swedish law.
