Complaining about a tradesperson – what does the Consumer Services Act say?

For craft services purchased by a private individual from a company, the Consumer Services Act (1985:716) is often applicable. A service may be defective if, for example, the result is not professional or deviates from what was agreed. To invoke a defect, the consumer must notify the trader within a reasonable time after the defect was or should have been discovered. A complaint made within two months of discovery is always considered timely according to Section 17.

For work on buildings, land and other fixed property, the ultimate limitation period for complaints is generally ten years after the assignment was completed. For other work, such as on movable property, three years often applies. The ten-year rule does not mean one can wait ten years after the defect was discovered. A longer period may also follow from a warranty or special legal circumstances. The Swedish Consumer Agency's current guidance.

What can the consumer demand from the tradesperson?

  • Remedy primarily: request that the company rectifies the defect free of charge within a reasonable time. The company often has the right to try to rectify the defect itself after a complaint.
  • Price reduction: may become relevant if the defect is not remedied according to legal requirements, for example supported by the cost of having the rectification performed by another party.
  • Cancellation (Hävning): requires a specific, more restrictive assessment; dissatisfaction with already completed work is not normally sufficient.
  • Damages: may relate to reasonable and substantiated additional costs in connection with the defect, but not automatically compensation for inconvenience or personal administration.
  • Withhold payment: according to Section 19, the consumer may withhold as much of the payment as is needed as security for a claim due to a defect in the service. Amounts and reasons should be communicated in writing. This is not a general right to stop paying everything.

Important: The template does not determine whether your particular work is defective or how large your claim may be. A quote or cost estimate is not the same as an actual expense, an approved price reduction or an established claim for damages.

How to use the complaint package step by step

  1. Gather the quote, the order, the invoice and the documentation of what was agreed.
  2. Note the date the work was completed and when each respective defect was discovered.
  3. Send the complaint letter in writing as soon as possible and save proof of postage.
  4. Describe each defect concretely in the defect report. Take photos, specify location and attach any expert statements.
  5. Request free-of-charge rectification and normally give the tradesperson the opportunity to investigate and suggest an action.
  6. Establish a realistic action plan and register the tradesperson's actual responses.
  7. If the deficiency persists: investigate whether a price reduction or compensation can be claimed and keep quotes and receipts separately.
  8. In case of withholding payment: assess the current claim and communicate the amount and reasons in writing.
  9. If you cannot agree: compile contract documents, photos, correspondence and the exact claims.
  10. Note the actual rectification, agreement or other actual conclusion – not just a planned date.

Excel – nine tabs for cases, evidence and cost follow-up

The workbook has Overview, Cases, Defects, Evidence, Contact, Actions, Costs, Dispute and Read me. The overview summarizes actual registrations and displays zero when no cases have been added. The cost tab clearly distinguishes between estimated cost and substantiated actual cost. To avoid misleading conclusions, no Excel formulas decide on legal complaint deadlines, right to cancellation, damages or payment withholding.

The tabs include status choices for, for example, planned action, verified completion and disputed cost documentation. Save sensitive information carefully and use internal references rather than full personal data.

Frequently asked questions

How do I write a complaint letter to a tradesperson?

State which parties are involved, what work was ordered, the date of performance and discovery, which concrete defects exist, attachments and what you are requesting. Send in writing and keep proof of when the message was sent.

How much time do I have to complain about defects in a renovation?

For work on buildings, land and other fixed property, the main rule is up to ten years after the work was completed. You must still complain within a reasonable time after discovery; within two months is always considered timely.

Do I have the right to demand money immediately?

Not automatically. Primarily, remedy may be relevant, and the company often has the opportunity to correct the defect itself. Price reduction, cancellation and damages require separate conditions.

Can I withhold payment if the tradesperson has done something wrong?

Under the conditions of the law, you can withhold the portion that is needed as security for your claim due to the defect. Document the amount, calculation and reasons in writing.

Does Excel calculate how much compensation I am entitled to?

No. It summarizes registered cost documentation and distinguishes quotes from actual expenses. No automatic legal assessment is included.

Are the main templates also in English?

No. The five main documents are in Swedish. Swedish and English user guides are included.
