About this template
Do you want to change or revoke a cohabitation agreement you have already written? With this digital template package, you can draw up a new written cohabitation agreement that changes the previous agreement. Choose a template for completely changing previous exclusions or a template for changing designated property. The package contains Word and PDF documents, user guides, and an Excel register for self-monitoring.
Important: Unlike a prenuptial agreement, a cohabitation agreement under the general rules of the Cohabitation Act must not be registered with the Swedish Tax Agency. According to Section 9 of the Cohabitation Act, the agreement must be in writing and signed by both cohabitants or prospective cohabitants.
Package contents

How do you revoke a cohabitation agreement?
According to Section 9 of the Cohabitation Act (2003:376), cohabitants or prospective cohabitants can change what they previously agreed through a new agreement. The new cohabitation agreement must be in writing and signed by both. Clearly state which provisions are being replaced and from which date you intend the new arrangement to take effect. Keep previous agreements together with the new document.
Change only part of the cohabitation agreement
Do you only want to change what applies to a particular home or specific household goods? Use the limited change agreement option and the property appendix. Describe the property and the previous condition so clearly that the content can be understood without conflicting references.
What exactly does a cohabitation agreement cover?
The rules of the Cohabitation Act on division of property primarily apply to a joint home and household goods acquired for joint use. Savings, shares, cars, holiday homes, and other assets do not become cohabiting property just because you change an agreement. Property with special gift or testamentary conditions, as well as the right to take over the home under Section 22 of the Cohabitation Act, requires separate consideration.
How to use the templates
- Retrieve the previously signed cohabitation agreement and any supplements.
- Check which property may be covered by the rules of the Cohabitation Act and which property has special conditions.
- Choose one of the two new cohabitation agreement originals.
- Customize the parties' details, the property concerned, the date, and the conditions.
- Review the agreement and have both parties sign the final written document.
- Save copies for both parties, as well as older agreements. No formal registration with an authority is normally required.
Frequently asked questions about changing a cohabitation agreement
Can we revoke a cohabitation agreement without writing a new one?
To reduce legal uncertainty, a new written cohabitation agreement signed by both parties is used to replace the old agreement. Section 9 of the Cohabitation Act expressly states that previous agreements may be changed through a new agreement.
Must the cohabitation agreement be registered with the Swedish Tax Agency?
No, a cohabitation agreement under Section 9 of the Cohabitation Act does not have the same registration requirements as a prenuptial agreement.
Must the cohabitation agreement be witnessed?
No, not according to the general form requirements of the Cohabitation Act. However, the parties should ensure that both have actually signed the final text.
Can only one cohabitant terminate the agreement?
A standard unilateral termination does not automatically change an agreement that, according to the law, must be changed through a new agreement. Both must participate in the new agreement change.
Can we make savings and a car cohabiting property?
The Cohabitation Act does not cover all types of property. Including such a provision in a cohabitation agreement does not in itself make savings or a car cohabiting property covered by the division of property rules of the Cohabitation Act.
Does ownership of the home change when we change the cohabitation agreement?
No. Questions about who owns property, loans, promissory notes, gifts, and division of property are separate from the cohabitation agreement's rules on exclusions from division of property.
What happens if we have already separated?
Then a different legal document may be needed. The Cohabitation Act contains special rules on division of property and time limits after the termination of a cohabitation relationship. According to Section 8, the general rule is that a request for division of property must be made within one year, with special rules in the event of death.
Are the files editable?
Yes, the agreement templates are editable in Word and the control register in Excel. The PDF files are searchable references and printouts, not automated legal forms.
Related templates and guides
If you want to write an initial cohabitation agreement, the Cohabitation agreement template is available. For a condominium and down payment, Cohabitation agreement and promissory note or Cohabitation agreement for condominium may also be relevant. If you have already separated, the Cohabitation division of property agreement can be used as a separate document type. See guides and information and all template categories.
Legal basis
The basis is the Cohabitation Act (2003:376), primarily Sections 3–9 and 22, as well as the Government Offices' information on cohabitation agreements. Special situations with international connections, unreasonable conditions, third-party rights, or division of property already underway may require individual consideration. The Excel register does not constitute a legal decision and cannot replace a signed agreement document.
