About this template

Application for a partitioner for estate distribution – complete document package for the district court. When the heirs of an estate cannot agree on the distribution of the estate, an authorized heir can apply for the district court to appoint a partitioner (skiftesman). With these editable documents, you can prepare the application, complete the heir information, and gather the relevant attachments.

01. The complete package in Word, PDF, and Excel

15 customer files: 7 DOCX + 7 searchable PDF + 1 XLSX. The package consists of five Swedish work documents and two user guides (Swedish and English) in both Word and PDF. It also includes an Excel register with nine work tabs. The PDFs are reading and printing versions of the Word files, not digital fillable forms.

Legal jurisdiction: Sweden. Version: 1.0, October 21, 2026. English content: English User Guide; the application templates are in Swedish.

02. A partitioner is not the same as an estate administrator

The partitioner (skiftesman) assists with the distribution of the estate and can carry out a compulsory division if necessary. An estate administrator (boutredningsman) primarily handles the investigation and management of the estate. If a court-appointed administrator or executor is already in place, you need to check whether they can act as a partitioner without a new court decision.

Cost warning: The application fee is 900 SEK according to current information from the Swedish Courts. The partitioner's work entails additional fees and costs which are paid by the estate.

How the Excel register works

The tabs are named Overview, Applications, Heirs, Attachments, Partition Issues, Costs, Communication, Checkpoints, and Read Me. The overview counts items and sums up manually entered costs and payments. The register data is administrative: it does not determine inheritance shares, record official applications, settle disputes, or calculate legal deadlines.

How to apply for a partitioner?

  1. Verify that you are an heir and that an already appointed estate administrator or executor is not fulfilling the role of partitioner.
  2. Select the competent district court according to court guidelines. As a general rule, this is the deceased's place of residence on November 1st of the year prior to the death.
  3. Fill in the editable application with details about the deceased, the applicant, and the heirs. State whether a will exists.
  4. Prepare a death certificate including a genealogical report, a registered estate inventory with attachments if available, and a certified copy of any will. The need for additional documents is assessed by the district court.
  5. State if a specific person is proposed. If you do not have a proposal, you can ask the district court to appoint someone suitable.
  6. Check the current application fee and send the application according to the district court's instructions. The court's e-service requires the attachments as PDFs and signing with BankID.

Legal information

The Inheritance Code, Chapter 23, Section 5 allows heirs to request a partitioner. This provision refers to Chapter 17 of the Marriage Code regarding the actual proceeding. The partitioner should strive for an agreement but can also perform a distribution that is served to the heirs. If an heir wishes to challenge the performed distribution, there is a special deadline of four weeks from the notification. The document package is not adapted for filing a challenge (klandertalan).

The Swedish Courts describe the information and attachments required, and that the application does not need to be made on any specific national form. Check the court's current instructions before submission.

Frequently asked questions

Can an heir apply alone?

Yes, an authorized heir can request that a partitioner be appointed. All known heirs must still be correctly listed in the application or the attachments.

Must I prove that the heirs are in disagreement?

According to information from the Swedish Courts, an application from an authorized heir generally does not need to be justified. The package's status update is optional.

What does a partitioner cost?

The court's application fee is 900 SEK according to information checked October 21, 2026. The partitioner's fee and expense reimbursement are additional and are paid by the estate.

Can I choose the partitioner?

You can propose a person and have them confirm that they wish to accept the assignment. The district court decides who is appointed.

Is it the same thing as an estate administrator?

No. They have different primary duties. However, an already appointed estate administrator or executor may in some cases already be the partitioner.

Does it include a finished estate distribution or court order?

No. The package contains the application and supporting documents but not a pre-executed estate distribution, registered inventory, or court decision.

Can I edit the PDF versions?
