About this template

Photography Agreement Template & Image License 2026/2027 – Word, PDF and Excel

Create a clear photography agreement for an assignment and document exactly which rights to images the client is permitted to use. This digital template package includes an editable photography agreement, a separate image license, an image appendix for the chain of rights, a supplementary license, and a delivery receipt.

For ongoing tracking, an Excel register with nine tabs is included for image IDs, licenses, publications, consent control, rights issues, and costs. The material is suitable for photographers, small businesses, e-retailers, advertising/communication agencies, and companies commissioning photography for advertising, products, and digital channels.

Total of 15 files: 7 Word (DOCX), 7 corresponding searchable PDF files, and 1 Excel (XLSX). Five main templates are in Swedish, and a Swedish and an English user guide are included.

Note the distinction between the photographer's copyright, the customer's usage license, and the rights of the individuals depicted. A photography agreement or a delivered image does not automatically guarantee that all rights or consents are secured.

Image License in Excel – rights register with dashboard

The Excel workbook contains the tabs Overview, Assignments, Image Register, Licenses, Publications, Costs, Consents, Checks, and Read Me. Each assignment, image, or license is given its own ID so that documents can be linked without repeating all personal information.

The overview has eight formula-based key performance indicators: registered photography assignments, images in the register, active license statuses, publications, consents for action, open checks, and calculated costs excluding and including VAT. All eight show zero when the registers are empty. Status simply means what you have registered – not that a license or publication is legally approved.

On the Costs tab, Excel calculates quantity × unit price and then a total amount according to a manually entered and verified VAT rate. A quality test with three units at SEK 1,200 each and 25 percent VAT yielded SEK 3,600 excluding and SEK 4,500 including VAT. The test data has not been saved in the delivery file.

Limitations: The register does not import data from an image bank, e-commerce platform, or advertising platform. It does not automatically check license agreements, is not a VAT or billing system, and does not replace individual copyright or GDPR assessments.

How to use the photography agreement – 10 steps

  1. Identify the parties: photographer, client, organization number, contact person, and date of the agreement.
  2. Describe the assignment: motif, shooting time, location, delivery format, scope, proofing rounds, and schedule.
  3. Determine the compensation: fee, additional work, external costs, payment date, and relevant VAT.
  4. Establish an image license: permitted channels, purpose, territorial scope, period, and any exclusivity.
  5. Decide on changes: explicitly check cropping, retouching, AI-related use, and sub-licensing.
  6. Create an image appendix: specify image ID and ensure that the creator and rights holder can be identified.
  7. Check persons in the image: examine the GDPR basis and special consent for names/images in advertising where the law requires it.
  8. Register in Excel: assignment, license, publication, and open questions with consistent IDs.
  9. Document the delivery: use a delivery receipt and distinguish between technical receipt and final approval.
  10. Manage new use: agree on a supplementary license and check personal data and advertising consents again if necessary.

Legal questions about photography agreements, copyright, and image licenses

Who owns the copyright to photographs?

The Copyright Act (1960:729) distinguishes between copyright-protected photographic works and the protection for certain photographic images under Section 49 a. Who has the right to grant permission and which rights can be licensed must be assessed. It is not sufficient to base this on who paid for the shoot or holds the digital file. There are special provisions for commissioned portrait images in Section 27.

What is the difference between a license and a transfer?

An image license provides the right to certain agreed use, such as on a website or in an advertising campaign during a specific time interval. A transfer means that agreed economic rights are transferred, in whole or in part, and may trigger other rules. The Copyright Act contains special provisions on reasonable compensation and information for certain transfers, including Sections 29–29 e. These questions must be assessed based on the actual agreement.

Must the photographer be credited?

The author's moral rights are regulated in Section 3 of the Copyright Act. Crediting and protection against offensive alterations shall be assessed according to the law and the conditions for the use. It is therefore appropriate to explicitly state the agreed form of credit and what applies to the editing of images.

Can the client publish images of people?

An image license from the photographer is not the same thing as a legal basis under the GDPR for processing data about the people depicted. The Swedish Authority for Privacy Protection (IMY) explains that an appropriate legal basis must be in place when identifiable people are published. Consent is a possible basis but not always the right one. Additionally, the Act (1978:800) on Names and Images in Advertising may require the depicted person's consent when a trader uses a name or image in their marketing.

May images be used for AI training, retouching, or in new campaigns?

Neither the photography assignment nor a generally worded image license should be assumed to permit all future uses. Specify purpose, right to edit, any automated uses, new distribution, and third-party access. The included supplementary license is intended to document such changes.

What applies if the photographs depict a child?

A child's integrity and any special protective needs must be assessed. Check in every concrete situation the authority of the guardians, the child's will and maturity, type of exposure, and which rights are affected. A general photography license is not a universal approval for publishing images of children.

Frequently asked questions about photography agreements and image licenses

Is a photography agreement needed for business photography?

A written agreement is recommended for clear delivery requirements, fees, rights granting, and approvals. It can prevent disagreement about later use of the images.

Does the client automatically own the copyright when they pay?

No, not generally. Payment and delivery of the file do not automatically provide all economic rights. The content of the agreement and special legal provisions must be reviewed.

Is an image license the same thing as photo consent?

No. The photographer licenses their usage rights, while the depicted person's personal data and advertising rights are assessed separately.

Can the license be limited to social media?

Yes. The use can be defined by media, period, territory, purpose, and other scope.

What do I do if the client wants to use the images in a new ad?

Check the original license and use the supplementary license to agree on an extension when the new use is not already covered.

Are photography agreements included in Word and PDF?

Yes. The five main templates are editable in Word and have corresponding searchable PDF versions.

Does Excel have an image and license overview?

Yes. It has nine tabs for, among other things, an image register, licenses, publications, consents, costs, and checks.

Does Excel calculate VAT and costs?

Yes, from quantity, unit price, and a manually entered and verified VAT rate. The template does not determine which VAT applies legally.

Are there English agreements in the package?

The main templates are in Swedish. An English User Guide is included, but not separate English main agreements.
