Important: this is the simple full-separate-property version
This template is intentionally broad. It is designed for couples who want all property each party owns now and later acquires to be that party's separate property. It also expressly addresses returns from the separate property.
If only one company, one property, a securities account or another specifically identified asset should be separate, a more narrowly drafted agreement is normally clearer.
What a Swedish marital property agreement does
Under Chapter 7 of the Swedish Marriage Code, spouses or prospective spouses can agree that property belonging to or later acquired by either party is to be separate property (enskild egendom). Property that is not separate property is generally marital property (giftorättsgods).
Marital property does not mean co-ownership. A Swedish marital property agreement does not, by itself, transfer ownership of a house, shares, bank funds or other assets between the parties. Ownership and the marital-property classification are separate legal questions.
Who this template is for
- Spouses or prospective spouses who want a straightforward full separate-property regime.
- Couples who want both present and future property to be separate.
- Couples who also want returns such as dividends, interest or rental income from the separate property to be separate.
- English-speaking users who need an English main document but are operating under Swedish law.
- Users who benefit from a Swedish reference copy for comparison.
When this template may not be suitable
- Only one specified asset should be separate.
- Only one party's property should be separate.
- You want different rules for different assets or categories of assets.
- You have an earlier marital property agreement and it is unclear how the new agreement should interact with it.
- There are significant international elements, such as residence, nationality or major assets in another country.
- Complex company holdings, pensions, insurance structures, tax planning or imminent divorce are central to the arrangement.
Returns and replacement property
Property that replaces separate property is generally also separate property unless otherwise provided. Returns from separate property are different: under the Swedish Marriage Code, returns are normally marital property unless the legal instrument creating the separate-property status provides otherwise.
This simple template expressly states that returns from the property covered by the agreement are also to be separate property. Read that clause carefully before signing so that it matches your intention.
No witnesses are required by the statutory form rule
A Swedish marital property agreement must be in writing, dated and signed by both spouses or prospective spouses and must be registered with the Swedish Tax Agency (Skatteverket). Witnesses are not a statutory form requirement.
Registration with the Swedish Tax Agency
The signed original should be sent for registration to Skatteverket, Äktenskapsregistret, 871 87 Härnösand, Sweden. The Swedish Tax Agency's registration fee is SEK 275 according to the information checked on 7 October 2026. Always verify the current fee and payment instructions before filing.
For prospective spouses, timing can be important. If the agreement is filed for registration within one month after the marriage, it takes effect from the date of marriage. If filed later, it takes effect from the date it is received for registration.
Registration is not a full legal merits review
Registration should not be interpreted as confirmation that every clause is substantively valid, fair or produces exactly the effect the parties expect. The Swedish Tax Agency's registration process is not a substitute for individual legal advice.
Divorce proceedings and death – timing matters
Current Swedish Tax Agency guidance emphasises that the filing date can be critical in connection with divorce proceedings or death. An agreement filed after the relevant cut-off point may not produce the intended effect in the subsequent division of property. Seek individual Swedish legal advice promptly if separation, divorce proceedings or death is imminent.
Unfair terms can be adjusted
Under Chapter 12, Section 3 of the Swedish Marriage Code, a term in a marital property agreement can in certain circumstances be adjusted or disregarded in a future division of property if it is unfair, taking into account the content of the agreement, the circumstances when it was made, later events and the circumstances overall. A registered agreement should therefore not be described as a guarantee of a particular future financial outcome.
Ownership, debts and inheritance are separate issues
This agreement does not automatically transfer ownership between the parties, make one party liable for the other's debts or determine who inherits after either party. If you also need to change ownership, document a loan, regulate co-ownership or plan inheritance, separate documents may be required.
How to use the package
- Read the English User Guide before editing the agreement.
- Enter both parties' full identifying details and addresses.
- State whether you are already married or are prospective spouses.
- Read the full-separate-property and returns clauses carefully.
- Review any earlier registered marital property agreement before signing.
- Print the final version, date it and have both parties sign it.
- Send the original to the Swedish Tax Agency for registration and pay the current filing fee.
- Keep a copy and retain the returned registered original in a safe place.
English main version – Swedish law
The English document is the main version of this product. It is expressly drafted as an English-language version governed by Swedish law. It is not presented as a UK prenuptial agreement, a US prenuptial agreement or a universal international legal form.
A Swedish reference version is included so the wording can be compared with Swedish terminology such as enskild egendom, giftorättsgods and äktenskapsförord.

Frequently asked questions
Is this a UK or US prenup?
No. The agreement is governed by Swedish law and is intended for use within the Swedish marital-property framework.
Do the signatures need witnesses?
No. Witnesses are not part of the statutory form requirements for a Swedish marital property agreement.
Can future property be covered?
Yes. A Swedish marital property agreement may cover property a party owns now or later acquires.
Are dividends and other returns automatically separate?
No. Returns from separate property are generally marital property unless otherwise provided. This template contains an express clause making returns separate as part of the full-separate-property arrangement.
Can we use this if only one company should be separate?
This package is deliberately broad and is not the best fit where only one specifically identified asset should be separate. Use a specified-property template instead.
Does registration guarantee the result?
No. Registration is required, but it is not a complete substantive legal review and does not guarantee a particular future division-of-property outcome.
Legal basis
Swedish Marriage Code (Äktenskapsbalk 1987:230), especially Chapter 7 Sections 1–3 and Chapter 12 Section 3, together with current Swedish Tax Agency information and legal guidance on registration of marital property agreements.
This package is general documentation support prepared with reference to Swedish law. It does not replace individual legal advice. Cross-border situations, earlier agreements, complex assets, special tax issues or unusual family circumstances may require tailored advice.
