About this template
Estate Distribution with Children from Previous Relationships and Secondary Inheritance – Word, PDF, and Excel
When a married person passes away and there are children from previous relationships, joint children, or a surviving spouse, an estate distribution may require a particularly careful assessment of the division of marital property, who receives an inheritance directly, questions regarding statutory shares (laglott), and potential rights of secondary inheritance. This specialist package helps estate beneficiaries and those assisting the estate to document actual legal grounds, approved distributions, supporting data, and execution without conflating claimed amounts with legally established rights.

Excel Register – nine work tabs and variance control
Overview summarizes registered assets, liabilities, open reserves, manually suggested distribution amounts, and discrepancies. Estate, Heirs, Assets, Liabilities, Distribution Shares, Secondary Inheritance, Evidence, and Read me provide separate traceable registers. Excel includes SUM and COUNTIF/COUNTIFS calculations, dropdown fields, and control of the difference between disposable funds and the proposed allocation.
Important: Excel never automatically determines a statutory share, does not approve a distribution, and does not interpret registered transfers as actually executed. Legal decisions, beneficiary approvals, and the bank's actual execution must be documented separately.
Legal Requirements – children from previous relationships, spouse, and secondary inheritance
According to Chapter 3, Section 1 of the Swedish Inheritance Code (ärvdabalken), a child from a previous relationship can normally claim their inheritance immediately upon the death of the parent who was married, whereas joint children normally inherit after the surviving spouse. The surviving spouse's protection, corresponding to four price base amounts, must be assessed separately based on the amount in the year of death and the circumstances. A child from a previous relationship may, under certain conditions, waive their inheritance in favor of the spouse according to Chapter 3, Section 9 and thereby obtain a right to secondary inheritance. Wills, statutory share claims under Chapter 7, division of marital property, and specific inheritance branches may change the assessment.
Chapter 23, Section 4 of the Inheritance Code requires a written estate distribution deed signed by the estate beneficiaries. Before distribution, debts, any division of marital property, and other rights must be handled according to applicable rules. The package does not replace a registered estate inventory (bouppteckning), bank forms, or individual legal advice; especially when the inheritance is contested, minors are involved, or real estate is concerned.
How to use the templates
- Gather the estate inventory, family investigation, will, and marital property division document.
- Identify all inheritance branches and who is legally an estate beneficiary.
- Examine the rights of children from previous relationships, spousal protection, wills, and any secondary inheritance with the correct supporting data.
- Register assets, liabilities, and verified balances in Excel and Annex 04.
- Document the actual agreed-upon allocation and sign the distribution deed.
- Follow bank instructions and execution separately, verifying every transaction.
Complementary templates and guides
For general estate distributions, there is an estate distribution deed with distribution annex. If you instead need to document that a child from a previous relationship waives their inheritance, you can read about inheritance waiver and renunciation. Before the distribution, the estate inventory package and final settlement with actual balance may be relevant. A separate will for children from previous relationships concerns planning before death and does not replace an estate distribution.
Frequently Asked Questions
Can children from previous relationships get their inheritance immediately?
Yes, according to the main rule for children who are not also the surviving spouse's children. Exceptions and limitations may follow from, among other things, spousal protection, inheritance waivers, and wills.
Does Excel calculate each heir's statutory share?
No. Excel keeps track of amounts, decisions, and discrepancies. The substantive content of the inheritance right is determined separately.
Does the package include a waiver of inheritance agreement?
No, this includes the supporting data to refer to an already executed inheritance waiver. The separate product for inheritance waivers is appropriate if this specific document needs to be drafted.
Have 2027 rules already been reviewed?
No. The source review was conducted on October 19, 2026. 2027 is a version designation, not a guarantee of future unchanged rules.
