À propos du modèle de document

A company has sent you a damage claim, withheld your deposit, or charged you an extra fee after you returned the rental car? This Word/PDF/Excel package helps you contest alleged rental car damage, request photographs and damage reports, demand a detailed breakdown of your deposit, and prepare a potential chargeback claim to your bank. You get five specific Swedish templates, guides in Swedish and English, and a nine-tab Excel spreadsheet.

Who is it for? Individuals who have rented a car from a company and need to deal with a specific post-rental claim. The documents can also help structure evidence when renting a car abroad, but the laws of the applicable country, the contract, and any cross-border dispute resolution procedures must be assessed separately.

01. Package contents

15 customer files: 7 editable Word documents (DOCX), 7 corresponding searchable and printable PDF files, and 1 Excel tool (XLSX) with nine tabs. Five templates and a user guide are in Swedish. An English User Guide describes the Swedish documents, but the operational templates are not translated into English. The PDF files are not interactive fillable forms.

02. What the files contain

Fields for the rental agreement, pickup date, return report, alleged damage, amount, damage photographs, cost calculation, insurance/deductible, deposit, reserved or actually charged card payment, refunds already received, and a contact log. The Excel spreadsheet separates unpaid claims from amounts actually charged. It calculates only administrative differences and does not determine legal liability.

How to contest a damage claim from the rental car company

  1. Find out what the company is claiming. Have you received an unpaid invoice? Has your card been charged? Or is a deposit simply reserved on your account? These are three different situations.
  2. Check the rental agreement and the condition of the car. Find the booking, pickup report, return receipt, photographs, and any damage that has already been noted. Check the insurance and deductible.
  3. Request concrete evidence of the damage. If you do not recognize the damage, request time-stamped photographs, both inspection reports, the date the damage was discovered, and a reasonable, well-documented repair or depreciation cost. Ask how the damage is linked to your specific rental period.
  4. Contest the claim in writing if it is incorrect. State which invoice or fees you are contesting and why. Keep evidence that the rental company received your objection. Contesting a claim is not the same as a final determination that you are not liable.
  5. Track the actual money. If funds have already been incorrectly charged, demand a correction from the company and, if necessary, contact your bank to initiate the correct card chargeback process. If the case goes to debt collection or the Enforcement Authority, follow the respective sender's own objection deadline.

What are the legal rules regarding damage to a rental car?

Must the car rental company show that the alleged damage occurred during my rental period?

According to the Swedish Consumer Agency's guidance on problems with rental cars, consumers can request evidence when the rental company claims that damage has occurred. Examples include reports, photographs, and documentation of the repair cost. If the damage was noted after the car was returned, it is relevant to investigate whether it may have occurred later. A fair assessment must take into account the rental terms, who caused the damage, and what evidence is available.

Am I liable for every piece of damage regardless of how careful I have been?

No, not through an unlimited standard term of strict liability. The Supreme Court of Sweden, PMÖD 2019:11 (PMT 5886-18) overturned an unreasonable standard term that made consumers liable for damage or theft regardless of fault. This ruling does not mean that no rental car damage can result in a payment obligation. Actual care, the contract, the circumstances, and any insurance coverage may be decisive.

What counts as normal wear and tear?

According to the Swedish Consumer Agency, rental car customers should normally not have to pay for normal wear and tear, such as minor paint scuffs and scratches that can be polished out. However, the difference between normal wear and compensable damage requires an individual assessment. Document 02 helps you request the photographs and valuation on which the claim is based.

Can the rental car company take my deposit without me being able to object?

According to the Swedish Consumer Agency's guidance, car rental companies may not charge money from your card or deposit for damage without giving you the opportunity to contest the claim. Still, first check what has actually happened: a reservation is not the same as an accounted charge. Ask the company and, if necessary, your bank to explain the status of the transaction. The correct refund method depends on what actually charged the account and on the terms of the contract.

Are fuel, cleaning, and road fees always prohibited?

No. The rental company may be entitled to certain post-rental charges when the rental terms and the actual events support them. Check the original fee, any administrative surcharge, receipts, meter reading, return photograph, and timeline. Document 04 is specifically designed for such disputes.

Can the bank help if the rental car company has already charged the money?

Card chargebacks may be relevant if you have requested a refund without success. Under certain conditions, credit card purchases may grant a right of objection under the Swedish Consumer Credit Act. Bank cards do not have the same general statutory right of chargeback, but the bank may still offer a refund according to its own terms and those of the card network. The bank's own forms and time limits apply.

Excel: nine tabs for claims, charges, and evidence

The Excel workbook has the tabs Read Me, Overview, Cases, Rentals, Damage Claims, Charges, Contacts, Evidence, and Actions. It maintains separate logs for alleged damage claims, the accepted portion, actual card charges, refunds received, and overdue items. You can record 100 rows in each log and use the case ID to find the correct documentation. It does not determine legal liability or the outcome of a card chargeback.

Tested example: damage claim of SEK 800 minus SEK 100 accepted portion = SEK 700 administratively contested portion. If SEK 300 was actually charged and SEK 50 refunded, the card charge difference is SEK 250. These two differences are not the same claim and must not be added together without scrutiny. All fictitious test data has been removed from the final Excel file. Empty logs show zero.

Frequently asked questions about rental car damage and deposits

Can I contest rental car damage that I do not recognize?

Yes, you can submit a written and factually justified objection. Request evidence, document the condition of the car, and explain which actual facts contradict the claim.

What should a damage claim include?

Request details of the damage, the date and time it was discovered, the inspection report, photographs, the terms of the contract, and documentation for the estimated repair cost or deductible.

Is a small scratch automatically damage I have to pay for?

No. Normal wear and tear should not be treated as compensable damage, but the size, location, and circumstances of this particular scratch must be assessed individually.

How can I get my rental car deposit back?

Check whether it has been reserved or actually charged. Request a detailed reason for withholding the amount and documentation for any fees. Document 03 is intended for this.

Can I contest a cleaning fee or fuel fee?

Yes, if you have reasonable grounds to believe that the contract or the actual event does not support the fee. Keep the fuel receipt, photographs, and return information.

Can I initiate a card chargeback with a bank card?

You can ask your bank. For bank cards, the bank's and card network's rules normally determine whether you can initiate a chargeback. For credit cards, a special right of objection may be relevant.

Can I contact ARN?

In a dispute with a rental car company in Sweden, ARN may be an option if its current monetary limits, time conditions, and other requirements are met. For rentals abroad, Consumer Europe and, in some cases, ECRCS may be relevant.

Are the PDF files editable?

They are searchable and printable, but are not interactive fillable forms. Use the seven Word files to make your own edits. The five templates are in Swedish.
