Om dokumentmallen
Notice of Shared Home – English template under Swedish cohabitation law (Word/PDF). Prepare a notice to the Swedish Land Registration Authority (Lantmäteriet – Fastighetsinskrivningen) requesting that a registered property or site leasehold be recorded as the shared home of two cohabiting partners. The revised English-first edition contains a formal notice, cover letter, separate step-by-step user guide and corresponding Swedish reference documents, all in Word and PDF.
This document is intended for Swedish real property (fastighet) or registered site leasehold (tomträtt) under Section 5 of the Swedish Cohabitees Act (Sambolagen, 2003:376). It is not a British or US property form, a transfer of legal title, a cohabitation agreement or a binding decision about division of property.
Under Section 5(2) of the Cohabitees Act, a qualifying property or site leasehold may be notified for notation in the Swedish Real Property Register. The authority decides whether to make the notation. It does not automatically transfer ownership or turn the property into assets to be divided between the partners.

What is a “notice of shared home” under Swedish law?
Under Section 5(2) of the Cohabitees Act (2003:376), cohabiting partners may notify the land registration authority that registered real property owned by one partner, or a site leasehold registered in one partner's name, is their shared home. Lantmäteriet's registration handbook also describes the procedure where both partners are registered owners or site leaseholders.
The resulting notation in the real property register is information about use of the home as shared housing. It is not a new deed, a new registered title (lagfart) or a declaration that the home must be divided equally when the relationship ends.
Three different concepts: shared home, cohabitation property and ownership
1. Shared home – Section 5
In broad terms, this concerns the dwelling used or intended as the couple's common home and held mainly for that purpose, as defined by Section 5 and its exceptions. The property can be used as the shared home even if only one of the partners is the registered owner.
2. Cohabitation property (samboegendom) – Section 3
For division of cohabitation property, whether the home was acquired for joint use is normally decisive, subject to exceptions in Sections 4, 7 and any valid cohabitation agreement under Section 9. A notation does not change the circumstances of acquisition.
3. Legal ownership
Ownership depends on valid acquisition and relevant title registration. Recording a shared home does not grant the other partner half the property. A change in ownership ordinarily requires another legal transaction and the applicable formalities.
Which housing types can use this template?
- Real property: a qualifying house or villa on an individually identified registered property unit, with a land-register designation and registered ownership.
- Registered site leasehold (tomträtt): where the partner is recorded as a holder and the other conditions are satisfied.
- Tenant-owned flat (bostadsrätt): not registered under this property-register notation procedure. Its rights and association records are handled separately.
- Rental home (hyresrätt): not within this specific real-property register notation procedure.
- Holiday-only home: normally outside the concept of a shared home where used predominantly for leisure under Section 7.
What practical difference can the notation make?
Section 23 of the Cohabitees Act restricts certain dealings with a shared home without the other partner's consent. A notation may matter in how Lantmäteriet processes a later transfer or mortgage registration. The authority's registration handbook states that, when the notation exists, it may require consent from the other partner or an explanation of why consent is unnecessary. The correct result remains dependent on the actual legal and factual circumstances.
This is not the same as an unconditional veto over every transaction, nor is it a guarantee of a partner's entitlement to property division. A separate written consent document may be required for relevant dealings.
Who should sign the notification?
The wording of Section 5 of the Cohabitees Act mentions a document signed by one of the partners. Lantmäteriet's Land Registration Handbook, Section 9.6.21 nevertheless says that the written notification is signed by both. The main template therefore contains signature fields for both partners as a practical precaution.
If only one person can sign, obtain guidance from the registration authority on what it will accept. We do not claim that the statute itself states an unconditional two-signature rule, nor can the template guarantee a favourable registration decision.
Step by step: how to complete and submit the notice
- Verify the relationship. Check that the parties meet the statutory definition of cohabitees in Section 1 (living together permanently as a couple in a joint household, neither married).
- Check the property type. This procedure is for qualifying registered real property or site leasehold, not a bostadsrätt or tenancy.
- Check registered ownership. Obtain the full official property designation (fastighetsbeteckning) and the registered name of the owner or site leaseholder.
- Complete the English notice. Enter both full names, identification details, postal address, municipality, property designation and declaration that the dwelling is the shared home.
- Arrange signatures. The form has fields for both partners in line with the registration handbook; resolve any different circumstances with Lantmäteriet.
- Check the authority's official form. Lantmäteriet provides the separate official application form Inskrivning eller borttag av anteckning. The Mallbutiken forms are support templates, not government-issued forms.
- Submit through an appropriate channel. Lantmäteriet currently lists fastighetsinskrivning@lm.se and asks for “anteckningsärende” in the subject for annotation matters. Confirm the current instructions and safe treatment of identity details before sending.
- Save the result. Keep a copy of the notice, supporting attachments, transmission confirmation, case number and registration decision or updated register extract.
Worked example – one partner already owns a house
Partner A purchased a Swedish house before the relationship began. Partner B later moves in, and the property becomes the couple's common home. Subject to the statutory conditions, the partners may request a notation that the property is their shared home. However, the notation does not transfer part of the house to Partner B and does not automatically make it property originally acquired for their joint use.
How is a shared-home notation removed?
Removal is a separate administrative matter. Lantmäteriet's public guidance states that both original notifying partners normally sign a request to remove this type of notation. Its Land Registration Handbook also describes cases in which removal may be assessed based on other evidence or an application by an affected person. Do not use the initial-notice template as a removal form; seek the current procedure.
Common mistakes to avoid
- Confusing a register notation with transfer of title or joint ownership.
- Assuming the property automatically becomes samboegendom for future division.
- Sending a free-form notice without checking Lantmäteriet's official form and procedures.
- Omitting the complete property-unit designation or registered owner's identity.
- Using a real-property form for a bostadsrätt or rental home.
- Assuming an emailed application has already been approved or noted in the register.
- Ignoring the signature discrepancy between the Act and the registration handbook.
- Sending sensitive or protected identity information over an unsafe channel without first contacting the authority.
Frequently asked questions
Is this a Swedish-law document written in English?
Yes. It is intended for a Swedish property or registered site leasehold and is governed by Swedish law. A Swedish reference form and guide are also included.
Does registration make us joint owners?
No. It does not alter registered title or convey a property share to the other cohabiting partner.
Will the property automatically be split if we separate?
No. Property division depends on the rules governing cohabitation property, including the purpose of acquisition and applicable exceptions or agreements.
Is registration compulsory for all cohabiting couples?
No. The statute provides an option to notify a qualifying home for notation; not all cohabitees must make such an application.
Can I use it for an apartment held as bostadsrätt?
No. The notice under Section 5(2) concerns real-property or site-leasehold notation. A bostadsrätt is not recorded by this particular procedure.
Are signatures from both partners required?
The legislation refers to a document signed by one partner, while the authority's registration handbook asks for both. The practical form has both signature lines. Consult Lantmäteriet where only one partner can sign.
Are these Lantmäteriet's official forms?
No. These are editable supporting templates. Always consult the official Inskrivning eller borttag av anteckning form and current submission instructions.
Are Word and PDF both included?
Yes. The updated ZIP has 12 files: 6 editable Word documents and 6 PDF versions across the two languages. The store owner must attach the updated ZIP manually before customers receive the new package.
